1010 To repeal section 386.050, RSMo, and to enact in lieu thereof one new section relating to the
1111 commissioners of the public service commission.

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 386.050, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 386.050, 2
1616 to read as follows:3
1717 386.050. 1. The commission shall consist of [five] 1
1818 seven members who shall be appointed by the governor, with 2
1919 the advice and consent of the senate, provided that no more 3
2020 than one member shall be appointed from each congressional 4
2121 district, and one of whom shall be designated by the 5
2222 governor to be chair of the commission. At least two 6
2323 members shall be actively engaged in production 7
2424 agriculture. Each commissioner, at the time of the 8
2525 commissioner's appointment and qualification, shall be a 9
2626 resident of the state of Missouri, and shall have resided in 10
2727 the state for a period of at least five years next preceding 11
2828 the appointment and qualification, and shall also be a 12
2929 qualified voter therein and not less than twenty -five years 13
3030 of age. Upon the expiration of each of the terms of office 14
3131 of the first commissioners, the term of office of each 15
3232 commissioner thereafter appointed shall be six years from 16
3333 the time of the commissioner's appointment and qualification 17
3434 and until his successor shall qualify. Vacancies in the 18 SB 9 2
3535 commission shall be filled by the governor for the unexpired 19
3636 term. 20
3737 2. As used in this section, "production agriculture" 21
3838 means using or cultivating land for the production of any, 22
3939 any combination, or all of the following for com mercial 23
4040 purposes: 24
4141 (1) Agricultural crops; 25
4242 (2) Livestock or livestock products; 26
4343 (3) Poultry or poultry products; 27
4444 (4) Milk or dairy products; 28
4545 (5) Fruit or other horticultural products; or 29
4646 (6) Fish or other aquaculture pro ducts. 30
