88 Submitting to the qualified voters of Missouri, an amendment to article I of the Constitution of
99 Missouri, by adding thereto one new section relating to reproductive health care.

1111 Be it resolved by the Senate, the House of Representatives concurring therein:
1212 That at the next general election to be held in the 1
1313 state of Missouri, on Tuesday next following the first Monday 2
1414 in November, 2026, or at a special election to be called by 3
1515 the governor for that purpose, there is he reby submitted to 4
1616 the qualified voters of this state, for adoption or 5
1717 rejection, the following amendment to article I of the 6
1818 Constitution of the state of Missouri:7
1919 Section A. Article I, Constitution of Missouri, is amended 1
2020 by adding thereto one new section, to be known as section 36(a), 2
2121 to read as follows:3
2222 Section 36(a). 1. The provisions of this section 1
2323 shall be known and may be cited as the "Reproductive Health 2
2424 Care Protection Act". 3
2525 2. Notwithstanding any provision of sectio n 36 of 4
2626 article I of this Constitution to the contrary, the right to 5
2727 reproductive freedom shall not be construed to include: 6
2828 (1) The performance of gender transition surgeries or 7
2929 the prescription or administration of cross -sex hormones or 8
3030 puberty-blocking drugs for the purpose of gender transition; 9

3232 (2) The payment for the performance or inducement, or 11
3333 assistance with the performance or inducement, of abortions 12
3434 by taxpayers, except in cases of medical emergencies. 13
3535 3. Notwithstanding any provision of section 36 of 14
3636 article I of this Constitution to the contrary, the right to 15
3737 reproductive freedom shall not be construed to exempt any 16
3838 person, firm, or corporation from civil liability for 17
3939 medical malpractice, negligence, or wrongfu l death. 18
4040 4. The general assembly shall have the authority to 19
4141 enact laws to carry out the provisions of this section. 20
4242 5. As used in this section, the following terms mean: 21
4343 (1) "Cross-sex hormones", testosterone, estrogen, or 22
4444 other androgens given to an individual in amounts that are 23
4545 greater or more potent than would normally occur naturally 24
4646 in a healthy individual of the same age and sex, but shall 25
4747 not include hormones used to treat individuals born with a 26
4848 medically-verifiable disorder of sex development or the 27
4949 treatment of any infection, injury, disease, or disorder 28
5050 unrelated to the purpose of gender transition; 29
5151 (2) "Gender transition surgery", a surgical procedure 30
5252 performed for the purpose of assisting an individual with 31
5353 identifying with and living as a gender different from his 32
5454 or her biological sex, but shall not include surgical 33
5555 procedures for individuals born with a medically -verifiable 34
5656 disorder of sex development or the treatment of any 35
5757 infection, injury, disease, o r disorder unrelated to the 36
5858 purpose of gender transition; 37
5959 (3) "Medical emergency", a condition which, based on 38
6060 reasonable medical judgment, so complicates the medical 39
6161 condition of a pregnant woman as to necessitate the 40
6262 immediate abortion of her p regnancy to avert the death of 41
6363 the pregnant woman or for which a delay will create a 42 SJR 23 3
6464 serious risk of substantial and irreversible physical 43
6565 impairment of a major bodily function of the pregnant woman; 44
6666 (4) "Puberty-blocking drugs", gonadotropin -releasing 45
6767 hormone analogues or other synthetic drugs used to stop 46
6868 luteinizing hormone secretion and follicle stimulating 47
6969 hormone secretion, synthetic antiandrogen drugs to block the 48
7070 androgen receptor, or any other drug used to delay or 49
7171 suppress pubertal development in children for the purpose of 50
7272 assisting an individual with a gender transition, but shall 51
7373 not include drugs used to treat individuals born with a 52
7474 medically-verifiable disorder of sex development or the 53
7575 treatment of any infection, injury, di sease, or disorder 54
7676 unrelated to the purpose of gender transition. 55
