88 Submitting to the qualified voters of Missouri, an amendment to article I of the Constitution of
99 Missouri, by adding thereto one new section relating to reproductive health care.

1111 Be it resolved by the Senate, the House of Representatives concurring therein:
1212 That at the next general election to be held in the 1
1313 state of Missouri, on Tuesday next following the first Monday 2
1414 in November, 2026, or at a special election to be called by 3
1515 the governor for that purpose, there is he reby submitted to 4
1616 the qualified voters of this state, for adoption or 5
1717 rejection, the following amendment to article I of the 6
1818 Constitution of the state of Missouri:7
1919 Section A. Article I, Constitution of Missouri, is amended 1
2020 by adding thereto one new section, to be known as section 36(a), 2
2121 to read as follows:3
2222 Section 36(a). 1. Notwithstanding any provision of 1
2323 section 36 of article I of this Constitution to the contrary: 2
2424 (1) No abortion shall be performed or induced upon a 3
2525 woman, except in cases of medical emergency; 4
2626 (2) No gender transition surgeries shall be knowingly 5
2727 performed on children under eighteen years of age and no 6
2828 cross-sex hormones or puberty -blocking drugs shall be 7
2929 knowingly prescribed or administered for the purpose of 8
3030 gender transition to children under eighteen years of age. 9
3131 The provisions of this section shall not apply to the use of 10
3232 such surgeries, drugs, or hormones to treat children born 11 SJR 9 2
3333 with a medically verifiable disorder of sex development or 12
3434 to treat any infection, injury, disease, or disorder 13
3535 unrelated to the purpose of a gender transition; and 14
3636 (3) The right to reproductive freedom shall not be 15
3737 construed to exempt any person, firm, or corporation from 16
3838 civil liability for medical malpr actice, negligence, or 17
3939 wrongful death. 18
4040 2. The general assembly shall have the authority to 19
4141 enact laws to carry out the provisions of this section. 20
4242 3. As used in this section, the following terms mean: 21
4343 (1) "Cross-sex hormones", testoster one, estrogen, or 22
4444 other androgens given to an individual in amounts that are 23
4545 greater or more potent than would normally occur naturally 24
4646 in a healthy individual of the same age and sex; 25
4747 (2) "Gender transition surgery", a surgical procedure 26
4848 performed for the purpose of assisting an individual with 27
4949 identifying with and living as a gender different from his 28
5050 or her biological sex; 29
5151 (3) "Medical emergency", a condition which, based on 30
5252 reasonable medical judgment, so complicates the medical 31
5353 condition of a pregnant woman as to necessitate the 32
5454 immediate abortion of her pregnancy to avert the death of 33
5555 the pregnant woman or for which a delay will create a 34
5656 serious risk of substantial and irreversible physical 35
5757 impairment of a major bodily function of the pregnant woman; 36
5858 (4) "Puberty-blocking drugs", gonadotropin -releasing 37
5959 hormone analogues or other synthetic drugs used to stop 38
6060 luteinizing hormone secretion and follicle stimulating 39
6161 hormone secretion, synthetic antiandrogen drugs to block the 40
6262 androgen receptor, or any other drug used to delay or 41
6363 suppress pubertal development in children for the purpose of 42
6464 assisting an individual with a gender transition. 43 SJR 9 3
6565 Section B. Pursuant to chapter 116, and other 1
6666 applicable constitut ional provisions and laws of this state 2
6767 allowing the general assembly to adopt ballot language for 3
6868 the submission of this joint resolution to the voters of 4
6969 this state, the official summary statement of this 5
7070 resolution shall be as follows: 6
7171 "Shall the Missouri Constitution be amended to: 7
7272 ● Prohibit surgeries, hormones, and drugs used 8
7373 on children for gender transitions; 9
7474 ● Permit abortions only in cases of medical 10
7575 emergencies; and 11
7676 ● Guarantee the right to reproductive health 12
7777 care does not limit liability for malpractice, 13
7878 negligence, or wrongful death?". 14
