44 NOTICE OF PROPOSED RULE CHANGE
55 Notice is hereby given by the Senator from the 17th District of the one day notice
66 required by rule of intent to put a motion to adopt the following rule change:
77 BE IT RESOLVED by the Senate of the One Hundred Third
88 General Assembly, First Regular Session, that Senate
99 Rules 10, 13, and 29 be amended to read as follows:

1111 The president pro tem shall be parliamentarian of the senate
1212 and may decide all points of order, and in his or her
1313 absence such points of order may be decided by the chairman
1414 of the Committee on the Judiciary and Civil and Criminal
1515 Jurisprudence, except in either case, the point of order may
1616 be referred by the then acting parliamentarian, to the
1717 Committee on Parliamentary Procedure for consideration and
1818 determination. All rulings on points of order shall be
1919 subject to an appeal to the senate and all questions and
2020 points of order shall be noted by the secretary with the
2121 decision thereon. (See also Rule 27.)
2222 The president pro tem shall be chosen by the senate, and if
2323 the president pro tem so chosen is absent, or his or her
2424 office vacant, the senate may pro ceed to elect an interim
2525 president pro tem to hold the office during such absence or
2626 other incapacity, at the pleasure of the senate.
2727 1. Senate offices and seats in the senate chamber shall be
2828 assigned by the committee on administration to the majority
2929 and minority caucuses. Each caucus shall make office and
3030 senate seat assignments on the basis of seniority as defined
3131 in this rule, unless otherwise determined within a caucus,
3232 except that Rooms 326 and 327 shall be known as the
3333 president pro tem's office and shall be occupied by the
3434 senate's president pro tem. Upon retirement from service as
3535 pro tem, that senator shall vacate the pro tem's office and

3737 shall have first choice of available vacant offices of his
3838 or her caucus, regardless of his or her seniority status.
3939 Except for the outgoing president pro tem, who is required
4040 to vacate the designated pro tem's office, no senator shall
4141 be required to relinquish any office or seat once assigned
4242 to him or her.
4343 2. Seniority shall be determi ned by each caucus on the
4444 basis of length of service. Length of service means:
4545 (a) Continuous senate service;
4646 (b) In the case of equal continuous senate service, prior
4747 non-continuous senate service;
4848 (c) In the case of equal continuous and prior non -
4949 continuous senate service, prior house service.
5050 3. When two or more members of the same party have the same
5151 length of service, their respective seniority shall be
5252 determined by their party caucus.
