8 | 8 | | General Assembly, First Regular Session, that Senate |

9 | 9 | | Rules 10, 13, and 29 be amended to read as follows: |

11 | 11 | | The president pro tem shall be parliamentarian of the senate |
---|
12 | 12 | | and may decide all points of order, and in his or her |
---|
13 | 13 | | absence such points of order may be decided by the chairman |
---|
14 | 14 | | of the Committee on the Judiciary and Civil and Criminal |
---|
15 | 15 | | Jurisprudence, except in either case, the point of order may |
---|
16 | 16 | | be referred by the then acting parliamentarian, to the |
---|
17 | 17 | | Committee on Parliamentary Procedure for consideration and |
---|
18 | 18 | | determination. All rulings on points of order shall be |
---|
19 | 19 | | subject to an appeal to the senate and all questions and |
---|
20 | 20 | | points of order shall be noted by the secretary with the |
---|
21 | 21 | | decision thereon. (See also Rule 27.) |

22 | 22 | | The president pro tem shall be chosen by the senate, and if |
---|
23 | 23 | | the president pro tem so chosen is absent, or his or her |
---|
24 | 24 | | office vacant, the senate may pro ceed to elect an interim |
---|
25 | 25 | | president pro tem to hold the office during such absence or |
---|
26 | 26 | | other incapacity, at the pleasure of the senate. |
---|
27 | 27 | | 1. Senate offices and seats in the senate chamber shall be |
---|
28 | 28 | | assigned by the committee on administration to the majority |
---|
29 | 29 | | and minority caucuses. Each caucus shall make office and |
---|
30 | 30 | | senate seat assignments on the basis of seniority as defined |
---|
31 | 31 | | in this rule, unless otherwise determined within a caucus, |
---|
32 | 32 | | except that Rooms 326 and 327 shall be known as the |
---|
33 | 33 | | president pro tem's office and shall be occupied by the |
---|
34 | 34 | | senate's president pro tem. Upon retirement from service as |
---|
35 | 35 | | pro tem, that senator shall vacate the pro tem's office and |
---|
36 | 36 | | 2 |
---|
37 | 37 | | shall have first choice of available vacant offices of his |
---|
38 | 38 | | or her caucus, regardless of his or her seniority status. |
---|
39 | 39 | | Except for the outgoing president pro tem, who is required |
---|
40 | 40 | | to vacate the designated pro tem's office, no senator shall |
---|
41 | 41 | | be required to relinquish any office or seat once assigned |
---|
42 | 42 | | to him or her. |
---|
43 | 43 | | 2. Seniority shall be determi ned by each caucus on the |
---|
44 | 44 | | basis of length of service. Length of service means: |
---|
45 | 45 | | (a) Continuous senate service; |
---|
46 | 46 | | (b) In the case of equal continuous senate service, prior |
---|
47 | 47 | | non-continuous senate service; |
---|
48 | 48 | | (c) In the case of equal continuous and prior non - |
---|
49 | 49 | | continuous senate service, prior house service. |

50 | 50 | | 3. When two or more members of the same party have the same |
---|
51 | 51 | | length of service, their respective seniority shall be |
---|
52 | 52 | | determined by their party caucus. |
