MISSISSIPPI LEGISLATURE 2025 Regular Session To: Local and Private Legislation By: Representatives Turner, Aguirre, Boyd (19th), Thompson House Bill 1986 (As Sent to Governor) AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF LEE COUNTY, MISSISSIPPI, TO ENTER INTO ONE OR MORE BINDING LEASE AGREEMENTS, LEASE PURCHASE ARRANGEMENTS AND/OR GROUND LEASES FOR A TERM NOT TO EXCEED 30 YEARS EACH FOR THE PURPOSES OF ACQUIRING, MAINTAINING, CONSTRUCTING OR EQUIPPING ONE OR MORE PUBLIC BUILDINGS AND RELATED FACILITIES TO BE LEASED OR SUBLEASED TO ONE OR MORE AGENCIES OF THE STATE OF MISSISSIPPI OR USED AS A PUBLIC SAFETY COMPLEX INCLUDING, BUT NOT LIMITED TO, MAKING ASSOCIATED INFRASTRUCTURE IMPROVEMENTS AND ACCESS ROAD IMPROVEMENTS; TO PROVIDE THAT ANY OBLIGATIONS ISSUED TO FINANCE SUCH FACILITIES MAY BE FINANCED FOR A TERM OF UP TO 30 YEARS; AND FOR RELATED PURPOSES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. As used in this act, the following terms shall have the meanings ascribed herein: (a) "Board of supervisors" means the Board of Supervisors of Lee County, Mississippi. (b) "County" means Lee County, Mississippi. SECTION 2. The Board of Supervisors is authorized and empowered, in its discretion and pursuant to Section 31-8-1, et seq., Mississippi Code of 1972, to enter into binding lease agreements, lease purchase agreements and/or ground leases for a term not to exceed thirty (30) years for the purpose of acquiring, maintaining, constructing or equipping one or more public buildings and related facilities to be leased or subleased to one or more agencies of the State of Mississippi (the "State") or used as a public safety complex, including, but not limited to, making associated infrastructure improvements and access road improvements. All other terms and provisions of any such lease agreement, lease purchase agreement and/or ground lease shall comply with the provisions of Section 31-8-1, et seq., Mississippi Code of 1972. SECTION 3. Any obligations, including certificates of participation, issued for the purpose of financing the acquisition, maintenance, construction or equipping of such public buildings and related facilities to be leased or subleased to one or more agencies of the state or used as a public safety complex may be for a term of up to thirty (30) years. SECTION 4. This act shall be deemed to be full and complete authority for the exercise of the powers granted under this act and shall not be in derogation of any existing law of this state, but shall be considered additional, supplemental and alternative to any other authority granted by law. SECTION 5. This act shall take effect and be in force from and after its passage.
