11 MISSISSIPPI LEGISLATURE 2025 Regular Session To: Public Health and Human Services By: Representative Currie House Bill 44 AN ACT TO PROHIBIT HEALTH PLANS FROM IMPOSING ANY CHARGE, FEE OR OTHER PAYMENT ON A HEALTH CARE PROVIDER FOR ELECTRONIC FUND TRANSFERS AND HEALTH CARE PAYMENT AND REMITTANCE ADVICE TRANSACTIONS MADE ON OR AFTER JULY 1, 2025; AND FOR RELATED PURPOSES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. (1) This section shall be known as the "No Fees for EFTs Act." (2) As used in this section, the following terms shall be defined as provided in this subsection: (a) "Health care provider" has the meaning as defined in 42 USC Section 1320d(3). (b) "Health plan" has the meaning as defined in 42 USC Section 1320d(5). (3) A health plan doing business in this state or doing business with a health care provider in this state, or any entity completing the transaction on behalf of the health plan, shall not impose any charge, fee or other payment (including through a withhold from payment) on a health care provider for electronic fund transfers and health care payment and remittance advice transactions made on or after July 1, 2025. SECTION 2. This act shall take effect and be in force from and after July 1, 2025.

1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

1717 SECTION 1. (1) This section shall be known as the "No Fees for EFTs Act."
