11 MISSISSIPPI LEGISLATURE 2025 Regular Session To: Business and Commerce By: Representative Rushing House Bill 694 AN ACT TO REQUIRE THE OWNER OF EACH PLACE OF BUSINESS WITH A RESTROOM THAT IS AVAILABLE FOR THE USE OF THE PUBLIC OR THE CUSTOMERS IN THE PLACE OF BUSINESS TO KEEP THE RESTROOM IN A CLEAN AND SANITARY CONDITION DURING THE TIME THAT THE BUSINESS IS OPEN TO CUSTOMERS; TO AUTHORIZE THE STATE DEPARTMENT OF HEALTH TO INSPECT ANY SUCH RESTROOM, AND REQUIRE THE DEPARTMENT TO INSPECT ANY SUCH RESTROOM UPON RECEIPT OF A COMPLAINT, TO ENSURE COMPLIANCE WITH THIS ACT; TO AUTHORIZE THE DEPARTMENT TO ORDER THE OWNER OF A BUSINESS TO TAKE SUCH ACTIONS AS ARE NECESSARY SO THAT THE RESTROOM OF THE BUSINESS IS IN A CLEAN AND SANITARY CONDITION; AND FOR RELATED PURPOSES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. (1) The owner of each place of business that has a restroom that is available for the use of the public or the customers in the place of business shall keep the restroom in a clean and sanitary condition during the time that the business is open to customers. (2) The State Department of Health may inspect any restroom that is subject to this section to ensure that the restroom is in a clean and sanitary condition, and shall inspect any such restroom upon receipt of a complaint that the restroom is not in a clean and sanitary condition. (3) If the department, upon inspection, finds that a restroom subject to this section is not in a clean and sanitary condition, the department may order the owner of the business to take such actions as are necessary so that the restroom is in a clean and sanitary condition. SECTION 2. This act shall take effect and be in force from and after July 1, 2025.
