1 | 1 | | MISSISSIPPI LEGISLATURE 2025 Regular Session To: Municipalities; Appropriations A By: Representatives Porter, Currie, Mangold, Mims, Cockerham House Bill 851 AN ACT TO CREATE THE TROY FLOYD ACT; TO PROVIDE THAT THE MISSISSIPPI DEVELOPMENT AUTHORITY SHALL ESTABLISH A PROGRAM TO PROVIDE GRANTS TO CERTAIN MUNICIPALITIES TO ASSIST IN PAYING COSTS ASSOCIATED WITH ACQUIRING LIFE SAVING EMERGENCY EQUIPMENT FOR THEIR POLICE DEPARTMENTS; TO PROVIDE AN APPLICATION PROCESS FOR THE GRANT PROGRAM; TO CREATE THE "SMALL MUNICIPALITIES POLICE DEPARTMENTS LIFE SAVING EMERGENCY EQUIPMENT FUND" AS A SPECIAL FUND IN THE STATE TREASURY; TO PROVIDE THAT MONIES IN THE FUND SHALL BE DISBURSED, UPON APPROPRIATION BY THE LEGISLATURE, BY THE MISSISSIPPI DEVELOPMENT AUTHORITY, TO PROVIDE GRANTS AUTHORIZED IN THIS ACT; AND FOR RELATED PURPOSES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. This act shall be known and may be cited as the "Troy Floyd Act". SECTION 2. (1) As used in this section, the following words and phrases shall have the meanings as defined in this subsection unless the context clearly indicates otherwise: (a) "Life saving emergency equipment" means bulletproof vests, radio equipment, first aid supplies and kits, and/or wound treatment supplies and equipment. (b) "Small municipality" means a municipality in the State of Mississippi with a population of three thousand (3,000) or less according to the most recent federal decennial census at the time the municipality submits its application to the Mississippi Development Authority under this section. (2) (a) The Mississippi Development Authority shall establish a program to provide grants to small municipalities to assist in paying costs associated with acquiring life saving emergency equipment for their police departments. A small municipality desiring assistance under the grant program established under this section must submit an application to the Mississippi Development Authority. The application must contain: (i) A description of the life saving emergency equipment to be acquired for the small municipality's police department; (ii) The cost of the life saving emergency equipment to be acquired; (iii) The amount of grant funds requested; and (iv) Any other information requested by the Mississippi Development Authority. (b) The Mississippi Development Authority shall review such application and determine whether the applicant is eligible to participate in the grant program. If the Mississippi Development Authority approves the applicant for participation in the grant program, the office shall issue a certificate of participation to the applicant designating the applicant as eligible to participate in the program. (c) The total amount of grant funds that may be provided to a small municipality under this section cannot exceed Fifty Thousand Dollars ($50,000.00) in the aggregate. (3) There is created in the State Treasury a special fund to be designated as the "Small Municipalities Police Departments Life Saving Emergency Equipment Fund", which shall consist of funds from any source designated for deposit into such fund. The fund shall be maintained by the State Treasurer as a separate and special fund, separate and apart from the General Fund of the state. Unexpended amounts remaining in the fund at the end of a fiscal year shall not lapse into the State General Fund, and any investment earnings or interest earned on amounts in the fund shall be deposited to the credit of the fund. Monies in the fund shall be disbursed by the Mississippi Development Authority, upon appropriation by the Legislature, for the purpose of providing grants under this section. SECTION 3. This act shall take effect and be in force from and after July 1, 2025. |
