1-MISSISSIPPI LEGISLATURE 2025 Regular Session To: Finance By: Senator(s) McMahan Senate Bill 2555 (As Sent to Governor) AN ACT TO AMEND SECTION 67-5-11, MISSISSIPPI CODE OF 1972, TO AUTHORIZE ANY NATIVE WINERY TO MAKE SALES TO THE DEPARTMENT OF REVENUE OR TO CONSUMERS AT ONE SATELLITE LOCATION IN THE SAME COUNTY AS THE NATIVE WINERY'S ORIGINAL LOCATION; AND FOR RELATED PURPOSES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: SECTION 1. Section 67-5-11, Mississippi Code of 1972, is amended as follows: 67-5-11. (1) Within the State of Mississippi, every native winery is authorized to make sales to the department or to consumers at the location of the native winery or its immediate vicinity, and additionally, at one (1) satellite location in the same county. Every native winery is authorized to make sales to any producer, manufacturer, wholesaler, retailer or consumer located outside of the State of Mississippi who are authorized by law to purchase the same. (2) With respect to native wines or distilled spirits sold by the department to retailers under Section 67-1-41, the native winery or distillery retailer may hold those wines or spirits for onsite pickup instead of shipping them to the department warehouse, at the option of the retailer and pursuant to any rules promulgated by the department. SECTION 2. This act shall take effect and be in force from and after its passage.
