                            MISSISSIPPI LEGISLATURE 2025 Regular Session To: Rules By: Senator(s) Chism, Hill, McLendon Senate Resolution 131 A RESOLUTION CALLING UPON MISSISSIPPI LOCAL LAW ENFORCEMENT ENTITIES TO ENTER INTO 287(g) AGREEMENTS RELATING TO IMMIGRATION ENFORCEMENT.      WHEREAS, President Donald J. Trump noted in Executive Order 14159, "Protecting the American People Against Invasion":      "Over the last 4 years, the prior administration invited, administered, and oversaw an unprecedented flood of illegal immigration into the United States.  Millions of illegal aliens crossed our borders or were permitted to fly directly into the United States on commercial flights and allowed to settle in American communities, in violation of longstanding Federal laws. Many of these aliens unlawfully within the United States present significant threats to national security and public safety, committing vile and heinous acts against innocent Americans.  Others are engaged in hostile activities, including espionage, economic espionage, and preparations for terror-related activities.  Many have abused the generosity of the American people, and their presence in the United States has cost taxpayers billions of dollars at the Federal, State, and local levels.   Enforcing our Nation's immigration laws is critically important to the national security and public safety of the United States"; and      WHEREAS, the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 added Section 287(g) to the Immigration and Nationality Act (INA) authorizing U.S. Immigration and Customs Enforcement (ICE) to delegate to state and local law enforcement officers the authority to perform specified immigration officer functions under the agency's direction and oversight; and      WHEREAS, the 287(g) Program enhances the safety and security of our nation's communities by allowing ICE Enforcement and Removal Operations (ERO) to partner with state and local law enforcement agencies to identify and remove criminal aliens; and      WHEREAS, the 287(g) Program allows ICE through the delegation of specified immigration officer duties to enhance collaboration with state and local law enforcement partners to protect American residents through the arrest and removal of aliens who undermine the safety of our nation's communities and the integrity of U.S. immigration laws; and      WHEREAS, specifically, ICE Enforcement and Removal Operations operates three 287(g) models:           (1)  The Jail Enforcement Model, which is designed to identify and process removable aliens with criminal or pending criminal charges arrested by state or local law enforcement agencies.           (2)  The Task Force Model, which serves as a force multiplier for law enforcement agencies to enforce limited immigration authority with ICE oversight during their routine police duties.           (3)  The Warrant Service Officer Program, which allows ICE to train, certify and authorize state and local law enforcement officers to serve and execute administrative warrants on aliens in their agency's jail; and      WHEREAS, Executive Order 14159 requires ICE to authorize State and local law enforcement officials, as the Secretary of Homeland Security determines are qualified and appropriate, under Section 287(g) of the Immigration and Nationality Act to "perform the functions of immigration officers in relation to the investigation, apprehension, or detention of aliens in the United States under the direction and the supervision of the Secretary of Homeland Security"; and      WHEREAS, countering the grave threat posed by the illegal immigration crisis requires that local law enforcement agencies cooperate with the federal government in the enforcement of immigration law.      NOW, THEREFORE, BE IT RESOLVED by the members of the Mississippi Senate, that the Senate calls upon all of Mississippi's local law enforcement entities to enter into 287(g) agreements with ICE to protect our communities against the threat posed by illegal, criminal aliens.      BE IT FURTHER RESOLVED, That the Secretary of the Senate is hereby authorized and directed to transmit a copy of this resolution to all local law enforcement entities in the State of Mississippi and make available to the Capitol Press Corps.
