5 A BILL FOR AN ACT ENTITLED: β€œAN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN 
6 AMENDMENT TO ARTICLE VIII, SECTION 16, OF THE MONTANA CONSTITUTION TO PROVIDE FOR A 
7 4% SALES TAX AND USE TAX TO REDUCE PROPERTY TAXES THAT FUND K-12 EDUCATION; AND 
8 PROVIDING AN EFFECTIVE DATE.”

10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

12 Article VIII, section 16, of The Constitution of the State of Montana is amended to read:
13 "Section   The rate of legislature 
14 shall dedicate the net revenue from a general statewide sales tax or and use tax may not exceed of 4% to 
15 reduce property taxes that fund K-12 education unless appropriated for other purposes by a vote of three-
16 fourths of the members of each house of the legislature."

18 NEW SECTION. Section 2.  Because [section 1] is a legislative proposal 
19 to amend the constitution, Article XIV, section 8, of the Montana constitution requires an affirmative roll call vote 
20 of two-thirds of all the members of the legislature, whether one or more bodies, for passage.

22 NEW SECTION. Section 3.  If approved by the electorate, [this act] is effective July 1, 
23 2027.

25 NEW SECTION. Section 4.  [This act] shall be submitted to the qualified 
26 electors of Montana at the general election to be held in November 2026 by printing on the ballot the full title of 
27 [this act] and the following:
