4 A BILL FOR AN ACT ENTITLED: β€œAN ACT REVISING PREAUTHORIZATION LAWS; PROVIDING 
5 DIRECTION TO THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO NOT REQUIRE 
6 AUTHORIZATION FOR CERTAIN ANTIPSYCHOTIC DRUGS; AND PROVIDING AN EFFECTIVE DATE AND 
7 AN APPLICABILITY DATE.”

9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

11 NEW SECTION. Section 1. 
12 department may not require prior authorization under the medicaid program for any antipsychotic drug 
13 approved by the federal drug administration that is recognized by the most recent edition of the Diagnostic and 
14 Statistical Manual of Mental Disorders adopted by the American psychiatric association as effective in the 
15 treatment of conditions that are specified in the manual.

17 NEW SECTION. Section 2.  [This act] is effective [30 days after this act is passed and 
18 approved].

20 NEW SECTION. Section 3.  [This act] applies to claims submitted for payment for 
21 services provided on or after [the effective date of this act].
