LYNCH 5 6 A BILL FOR AN ACT ENTITLED: βAN ACT REVISING THE SALARY OF THE STATE AUDITOR; CLARIFYING 7 THAT THE STATE AUDITOR IS ALSO THE EX OFFICIO COMMISSIONER OF INSURANCE AND 8 SECURITIES; AMENDING SECTION 2-16-405, MCA; AND PROVIDING AN APPLICABILITY DATE.β 9 10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA: 11 12 Section 2-16-405, MCA, is amended to read: 13 "2-16-405. (1) The salaries paid to the following elected 14 officials are determined as provided in subsection (2): 15 (a) governor; 16 (b) lieutenant governor; 17 (c) attorney general; 18 (d) state auditor, ex officio commissioner of insurance and securities; 19 (e) superintendent of public instruction; 20 (f) public service commission presiding officer; 21 (g) public service commissioners, other than presiding officer; 22 (h) secretary of state; 23 (i) clerk of the supreme court. 24 (2) Before June 30 of each even-numbered year, the department of administration shall conduct a 25 salary survey of executive branch officials with similar titles to the Montana officials listed in subsection (1) for 26 the states of North Dakota, South Dakota, Wyoming, and Idaho. The department shall include the salary for the 27 Montana official in determining the average salary for the officials with similar titles.
