10 A BILL FOR AN ACT ENTITLED: β€œAN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN 
11 AMENDMENT TO THE MONTANA CONSTITUTION TO REPEAL ARTICLE XIII, SECTION 7, WHICH 
12 PROHIBITS SAME-SEX MARRIAGES; AND PROVIDING AN EFFECTIVE DATE.”

14 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

16 NEW SECTION. Section 1.  Article XIII, section 7, of The Constitution of the State of 
17 Montana is repealed.

19 NEW SECTION. Section 2.  Because [section 1] is a legislative proposal 
20 to amend the constitution, Article XIV, section 8, of the Montana constitution requires an affirmative roll call vote 
21 of two-thirds of all the members of the legislature, whether one or more bodies, for passage.

23 NEW SECTION. Section 3.  If approved by the electorate, [this act] is effective 
24 January 1, 2027.

26 NEW SECTION. Section 4.  [This act] shall be submitted to the qualified 
27 electors of Montana at the general election to be held in November 2026 by printing on the ballot the full title of 
28 [this act] and the following: 2026
