17-ADMINISTRATION FOR A TWELFTH GRADE TRANS ITION PROGRAM FOR 6
18-CERTAIN INDIAN EDUCATION STUDENTS. 7
19-The General Assembly of North Carolina enacts: 8
20-SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended 9
21-by adding the following new sections to read: 10
22-"§ 143-64.5A. Certain educational institutions exempt. 11
23-Notwithstanding any provisions or limitations of Part 2 of this Article, an educational 12
24-organization is authorized and empowered to obtain decommissioned and surplus material and 13
25-property under contracts and agreements with the federal government or any of its departments 14
26-or agencies provided that the material and property is intended to be used for educational 15
27-purposes. For the purposes of this section, the term "educational organization" means an 16
28-organization that has education as its primary purpose and that is a nonprofit organization, a 17
29-not-for-profit organization, or an organization that has tax-exempt status under 26 U.S.C. § 18
30-501(c)(3). 19
31-"§ 143-64.5B. Public safety exemption. 20
32-Notwithstanding any provisions or limitations of Part 2 of this Article, any State agency is 21
33-authorized and empowered to obtain decommissioned and surplus material and property under 22
34-contracts and agreements with the federal government or any of its departments or agencies 23
35-provided that the material and property is intended to promote public safety. For the purposes of 24
36-this section, the term "State agency" means any board, bureau, commission, department, 25
37-institution, or agency of the State." 26
38-SECTION 2. Notwithstanding any provision of S.L. 2023-134 to the contrary, the 27
39-sum of five million dollars ($5,000,000) in nonrecurring funds appropriated to the Department 28
40-of Public Instruction to contract with MyScholar, LLC, shall instead be allocated to the 29
41-Department of Administration for use by the Commission on Indian Affairs to contract with 30
42-MyScholar, LLC, to support the ScholarPath platform in developing the Twelfth Grade 31
43-Transition Program for Indian Education students in grades six through 12 to match students with 32
44-pathways aligned with their career interests. 33
45-SECTION 3. This act is effective when it becomes law. 34

29+that is a nonprofit organization, a not-for-profit organization, or an organization that has 16
30+tax-exempt status under 26 U.S.C. § 501(c)(3)." 17
