17 | 16 | | SECTION 1. G.S. 20-158 is amended by adding a new subsection to read: 4 |

18 | 17 | | "(f) The following requirements apply to a traffic control photographic system used to 5 |

19 | 18 | | enforce this section: 6 |

20 | 19 | | (1) A violation detected by a traffic control photographic system is defined as 7 |
---|
21 | 20 | | when a vehicle enters and proceeds into the intersection after the onset of the 8 |
---|
22 | 21 | | signal display of a steady circular red or steady red arrow controlling traffic 9 |
---|
23 | 22 | | approaching the intersection and the applicable red clearance interval has 10 |
---|
24 | 23 | | expired. All signals with traffic control photographic systems must be 11 |
---|
25 | 24 | | designed with an appropriate red clearance interval. 12 |
---|
26 | 25 | | (2) The duration of the yellow light change interval and the red clearance interval 13 |
---|
27 | 26 | | at intersections where traffic control photographic systems are in use shall be 14 |
---|
28 | 27 | | no less than the yellow light change interval and the red clearance interval 15 |
---|
29 | 28 | | durations specified on the traffic signal plan of record signed and sealed by a 16 |
---|
30 | 29 | | professional engineer, licensed in accordance with the provisions of Chapter 17 |
---|
31 | 30 | | 89C of the General Statutes, and shall comply with the provisions of the most 18 |
---|
32 | 31 | | recently adopted Manual on Uniform Traffic Control Devices." 19 |

33 | 32 | | SECTION 2. This act is effective 60 days after it becomes law and applies to any 20 |
---|
34 | 33 | | enforcement of G.S. 20-158 by a traffic control photographic system, including by any 21 |
---|
35 | 34 | | municipality authorized under G.S. 160A-300.1, and S.L. 2001-286, as amended. 22 |
