| 18 | 17 | | The General Assembly of North Carolina enacts: 5 |

| 19 | 18 | | SECTION 1. Notwithstanding any other provision of law, a municipality may, upon 6 |

| 20 | 19 | | a finding that a fund balance in a utility or public service enterprise fund used for the operation 7 |
|---|
| 21 | 20 | | of a wastewater collection, treatment, and disposal system exceeds the requirements for funding 8 |
|---|
| 22 | 21 | | the operation of that fund, including closure and post-closure expenditures, transfer the excess 9 |
|---|
| 23 | 22 | | funds to be used to support the other services supported by the municipality's general fund. The 10 |

| 24 | 23 | | intent of this act is to authorize the transfer of funds and not to, in any way, affect the operation 11 |

| 25 | 24 | | of a wastewater collection, treatment, and disposal system. 12 |

| 26 | 25 | | SECTION 2. This act applies to the Town of Tabor City only. 13 |
