14+AN ACT TO PROVIDE FOR THE PARTISAN ELECTION OF MEMBERS TO THE PITT 2

1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1.(a) Section 1 of Chapter 193 of the 1987 Session Laws, as amended by 5
17-S.L. 2013-318, reads as rewritten: 6
18-"Section 1. Beginning in December 2014, the The Pitt County Board of Education shall 7
19-consist of nine members. Nine members shall be elected from single-member districts, as 8
20-described in Section 5. Only voters residing in the district may vote for the member from that 9
21-district." 10
22-SECTION 1.(b) Section 4 of Chapter 193 of the 1987 Session Laws, as amended by 11
23-S.L. 2013-318, reads as rewritten: 12
24-"Section 4. Elections shall be held on a partisan basis in even-numbered years as terms expire, 13
25-at the time of the regular election of general election. Candidates for election to the Pitt County 14
26-Board of Education shall be nominated at the same time and manner as other county officers. 15
27-Members shall take office at the time set by general State law on the first Monday in December 16
28-following the election and shall serve for staggered terms of four years. Members shall serve 17
29-until a successor has been elected and qualified. Except as otherwise provided, the election shall 18
30-be conducted in accordance with Chapters 115C and 163 of the General Statutes." 19
31-SECTION 1.(c) Section 6 of Chapter 193 of the 1987 Session Laws reads as 20
32-rewritten: 21
33-"Sec. 6. Vacancies on the Pitt County Board of Education shall be filled by appointment by 22
34-the remaining members of the Board. The person appointed shall serve until the next regularly 23
35-scheduled election for county boards of education, at which time a person shall be elected to fill 24
36-the remainder of the unexpired term or, if the term is due to expire that year, a new term. The 25
37-person appointed to fill a vacancy must reside in the same district as the departing member.in 26
38-accordance with G.S. 115C-37.1." 27
39-SECTION 1.(d) This section does not affect the term of office of any member elected 28
40-in 2024 to the Pitt County Board of Education. Any vacancy on the Pitt County Board of 29
41-Education for a member elected in 2024 shall be filled by appointment by the remaining members 30
42-of the Pitt County Board of Education to serve the remainder of the unexpired term. Each member 31
43-of the Pitt County Board of Education elected in 2024, or any member appointed to fill a vacancy 32
44-in 2024, shall serve until a successor has been elected and qualified. 33
45-SECTION 2. G.S. 115C-37.1(d) reads as rewritten: 34
46-"(d) This section shall apply only to the Hickory City Board of Education and the 35
47-Newton-Conover City Board of Education and in the following counties: Alleghany, Ashe, 36 General Assembly Of North Carolina Session 2025

18+Section 2(a) of S.L. 2013-318 and Section 3(a) of S.L. 2013-318, reads as rewritten: 6
19+"Section 1. Beginning in December 2014, the Pitt County Board of Education shall consist 7
20+of nine members. Nine members Members of the Board of Education shall be elected on a 8
21+partisan basis, as provided in G.S. 163-291, at the time of the general election in each 9
22+even-numbered year as terms expire. Candidates for election to the Board of Education shall be 10
23+nominated at the same time and manner as other county officers. Members shall take office on 11
24+the first Monday in December following the election. Members shall serve until a successor has 12
25+been elected and qualified. Except as otherwise provided, the election shall be conducted in 13

39+remainder of an unexpired term for a member elected in 2022 or 2024, shall serve until a 27
40+successor has been elected and qualified. Any vacancy on the Pitt County Board of Education 28
41+for a member elected in 2022 and 2024 shall be filled by appointment by the remaining members 29
42+of the Board. 30
43+SECTION 1.(d) This section is effective when it becomes law and applies beginning 31
44+with elections held on or after that date. 32
45+SECTION 2.(a) G.S. 115C-37.1(d) reads as rewritten: 33

53-SECTION 3. This act becomes effective the first Monday in December of 2026, and 5
54-elections in 2026 and thereafter shall be conducted accordingly. 6
53+SECTION 2.(b) This section becomes effective December 1, 2026. 5
54+SECTION 3. Except as otherwise provided by this act, this act is effective when it 6
55+becomes law. 7
