14	14		AN ACT TO PROVIDE FOR THE EXPEDIENT IMPLEMENTATION OF MEDICAID 2
15	15		WORK REQUIREMENTS . 3
16	16		The General Assembly of North Carolina enacts: 4
17	17		SECTION 1. Section 2.4 of S.L. 2023-7 reads as rewritten: 5
18	18		"SECTION 2.4. If there is any indication that work requirements as a condition of 6
19	19		participation in the Medicaid program may be authorized by the Centers for Medicare and 7
20	20		Medicaid Services (CMS), then the Department of Health and Human Services, Division of 8
21	21		Health Benefits (DHB), shall enter into negotiations with CMS to develop a plan for those work 9
22	22		requirements and to obtain approval of that plan. Within 30 days of entering into negotiations 10
23	23		with CMS pursuant to this section, DHB shall notify, in writing, the Joint Legislative Oversight 11
24	24		Committee on Medicaid (JLOC) and the Fiscal Research Division (FRD) of these negotiations. 12
25	25		Within 30 days of approval by CMS of a plan for work requirements as a condition of 13
26	26		participation in the Medicaid program, DHB shall submit a report to JLOC and FRD containing 14
27	27		the full details of the approved work requirements, including the approved date of 15
28	28		implementation of the requirements and any funding necessary to implement or maintain the 16
29	29		requirements. Notwithstanding any provision of G.S. 108A-54.3A to the contrary, the 17
30	30		Department of Health and Human Services shall implement any work requirements as a condition 18
31	31		of participation in the Medicaid program approved by the Centers for Medicare and Medicaid 19
32	32		Services in accordance with this section." 20
33	33		SECTION 2. This act is effective when it becomes law. 21
