1514 AN ACT TO PROVIDE MILITARY FAMILIES ADDITIONAL TIME TO PROVIDE PROOF 2
1615 OF RESIDENCY FOR PUBLIC SCHOOL ENROLLMENT . 3
1716 The General Assembly of North Carolina enacts: 4
1817 SECTION 1. G.S. 115C-366(a9) reads as rewritten: 5
1918 "(a9) A student who is not a domiciliary of a local school administrative unit that resides 6
2019 with a parent or legal guardian that is on active military duty shall be permitted to register to 7
2120 enroll in the public schools of that unit by remote means, including electronic means, prior to 8
2221 commencement of the student's residency in the local school administrative unit if all of the 9
2322 following apply:subject to the following conditions: 10
2423 (1) To be eligible to register to enroll prior to becoming a domiciliary, all of the 11
2524 following conditions must be met: 12
2625 a. A parent or legal guardian is on active military duty and (i) is 13
2726 transferred or pending transfer pursuant to an official military order to 14
2827 a military installation or reservation in the State.State or (ii) is 15
2928 separating from active duty service within the next 12 months and 16
3029 intends to establish residency in the State. 17
3130 (2)b. Upon request by the local school administrative unit where the student 18
3231 seeks to register to enroll, a parent or legal guardian provides (i) a copy 19
3332 of the official military order transferring to a military installation or 20
3433 reservation located in the State.State or (ii) an official military 21
3534 document showing an anticipated date of separation. Each local school 22
3635 administrative unit may determine the document or documents 23
3736 sufficient to establish an anticipated date of separation so long as the 24
3837 document required is easily accessible by the parent or legal guardian. 25
3938 (3)c. A parent or legal guardian completes and submits the local school 26
4039 administrative unit's required enrollment forms and documentation, 27
4140 except that proof of residency and documentation related to 28
4241 disciplinary actions pursuant to G.S. 115C-366(a4) shall not be 29
4342 required until the student transfers into the local school administrative 30
4443 unit, at which time they shall be required prior to commencing 31
4544 attendance. 32

48-a. A local school administrative unit shall make available to a student 1
49-who registers to enroll pursuant to this subsection the same 2
50-opportunities available to a student enrolled contemporaneously with 3
51-domicilia, such as requesting or applying for school assignment, 4
52-registering for courses, and applying for any other programs that 5
53-require additional request or application. 6
54-b. A student enrolled pursuant to this subsection may not attend school 7
55-in the local school administrative unit until proof of residency is 8
56-provided in accordance with the requirements of the local school 9
57-administrative unit.the later of (i) one year from the parent or legal 10
58-guardian's reporting-for-duty or separation date or (ii) the end of the 11
59-school year in which the student began attending the school. The 12
60-parent or legal guardian shall provide proof of residency before the 13
61-expiration of the allotted period of attendance provided in this 14
62-sub-subdivision. 15
63-c. If a student begins attending a school pursuant to this subsection in 16
64-grade 11 or 12, the local school administrative unit shall extend the 17
65-period of attendance allowed under sub-subdivision b. of this 18
66-subdivision to allow the student to attend the school through high 19
67-school graduation. 20
68-Nothing in this subsection shall be construed to curtail a local school administrative unit's 21
69-authority pursuant to G.S. 115C-366(a5)." 22
70-SECTION 2. This act is effective when it becomes law and applies beginning with 23
71-the 2025-2026 school year. 24
