1515 RECREATION TRUST FUND FOR INCLUSIVE PLAYGROUNDS . 3
1616 The General Assembly of North Carolina enacts: 4
1717 SECTION 1. G.S. 143B-135.56 reads as rewritten: 5
1818 "§ 143B-135.56. Parks and Recreation Trust Fund. 6
1919 (a) Fund Created. – There is established a Parks and Recreation Trust Fund in the State 7
2020 Treasurer's Office. The Trust Fund shall be a special revenue fund consisting of donations, gifts, 8
2121 and devises to the Trust Fund and other monies appropriated to the Trust Fund by the General 9
2222 Assembly. 10
2323 (b) Use. – Funds in the Trust Fund are annually appropriated to the North Carolina Parks 11
2424 and Recreation Authority and, unless otherwise specified by the General Assembly or the terms 12
2525 or conditions of a gift or grant, shall be allocated and used as follows: 13
2626 (1) Sixty-five percent (65%) for the State Parks System or a State recreational 14
2727 forest for capital projects, repairs and renovations of park facilities, and land 15
2828 acquisition. 16
2929 (2) Thirty percent (30%) to provide matching funds to local governmental units 17
3030 or public authorities as defined in G.S. 159-7 on a dollar-for-dollar basis for 18
3131 local park and recreation purposes. The appraised value of land that is donated 19
3232 to a local government unit or public authority may be applied to the matching 20
3333 requirement of this subdivision. These funds shall be allocated by the North 21
3434 Carolina Parks and Recreation Authority based on criteria patterned after the 22
3535 Open Project Selection Process established for the Land and Water 23
3636 Conservation Fund administered by the National Park Service of the United 24
3737 States Department of the Interior. Funds appropriated for inclusive parks 25
3838 facilities under subsection (h) of this section shall be awarded separately and 26
3939 not be counted toward the percentage cap set forth in this subdivision. 27
4040 (3) Five percent (5%) for the Coastal and Estuarine Water Beach Access Program. 28
4141 (c) Geographic Distribution. – In allocating funds in the Trust Fund under this section, 29
4242 the North Carolina Parks and Recreation Authority shall make geographic distribution across the 30
4343 State to the extent practicable. 31
4444 (d) Administrative Expenses. – Of the funds appropriated to the North Carolina Parks 32
4545 and Recreation Authority from the Trust Fund each year, no more than three percent (3%) may 33
4646 be used by the Department for operating expenses associated with managing capital 34

4952 (e) Operating Expenses for State Parks System Allocations. – In allocating funds in the 1
5053 Trust Fund under subdivision (1) of subsection (b) of this section, the North Carolina Parks and 2
5154 Recreation Authority shall consider the operating expenses associated with each capital project, 3
5255 repair and renovation project, and each land acquisition. In considering the operating expenses, 4
5356 the North Carolina Parks and Recreation Authority shall determine both: 5
5457 (1) The minimal anticipated operating expenses, which are determined by the 6
5558 minimum staff and other operating expenses needed to maintain the project. 7
5659 (2) The optimal anticipated operating budget, which is determined by the level of 8
5760 staff and other operating expenses required to achieve a more satisfactory 9
5861 level of operation under the project. 10
5962 (f) Reports. – The North Carolina Parks and Recreation Authority shall report no later 11
6063 than October 1 of each year to the Joint Legislative Oversight Committee on Agriculture and 12
6164 Natural and Economic Resources, the Fiscal Research Division, and the Environmental Review 13
6265 Commission on allocations from the Trust Fund from the prior fiscal year. For funds allocated 14
6366 from the Trust Fund under subsection (c) of this section, this report shall include the operating 15
6467 expenses determined under subdivisions (1) and (2) of subsection (e) of this section. 16
6568 (g) Debt. – The Authority may allocate up to fifty percent (50%) of the portion of the 17
6669 annual appropriation identified in subdivision (b)(1) of this section to reimburse the General Fund 18
6770 for debt service on special indebtedness to be issued or incurred under Article 9 of Chapter 142 19
6871 of the General Statutes for the purposes provided in subdivision (b)(1) of this section and for 20
6972 waterfront access. In order to allocate funds for debt service reimbursement, the Authority must 21
7073 identify to the State Treasurer the specific parks projects for which it would like special 22
7174 indebtedness to be issued or incurred and the annual amount it intends to make available, and 23
7275 request the State Treasurer to issue or incur the indebtedness. After special indebtedness has been 24
7376 issued or incurred for a parks project requested by the Authority, the Authority must credit to the 25
7477 General Fund each year the actual aggregate principal and interest payments to be made in that 26
7578 year on the special indebtedness, as identified by the State Treasurer. 27
7679 (h) Continuing Appropriation for Inclusive Playgrounds. – The General Assembly finds 28
7780 that there is a critical need in this State for construction of special parks facilities or adaptation 29
7881 of existing parks facilities for persons with disabilities, and therefore it is essential that the State 30
7982 provide continuing dedicated funding to the Trust Fund for this purpose. Therefore, there is 31
8083 appropriated from the General Fund to the Trust Fund in each fiscal year the sum of one hundred 32
8184 thousand dollars ($100,000) to be used for grants to local governmental units, public school units, 33
8285 or public authorities, as defined in G.S. 159-7, for construction of special facilities or adaptation 34
8386 of existing facilities that meet the unique needs of persons with disabilities or that enable them 35
8487 to participate in recreational and sporting activities, regardless of their abilities. Grants made 36
8588 under this subsection shall not exceed five thousand dollars ($5,000), and the local governmental 37
8689 unit, public school unit, or public authority receiving a grant under this subsection shall provide 38
8790 matching funds in the amount of one dollar ($1.00) of local funds for every five dollars ($5.00) 39
8891 of State funds." 40
8992 SECTION 2. This act becomes effective July 1, 2025. 41
