1414 AN ACT APPROPRIATING FUNDS TO THE OFFICE OF STATE BUDGET AND 2
1515 MANAGEMENT FOR A FERTILITY PRESERVATION PILOT PROGRAM . 3
1616 The General Assembly of North Carolina enacts: 4
1717 SECTION 1.(a) There is appropriated from the General Fund to the Office of State 5
1818 Budget and Management the sum of two million two hundred fifty thousand dollars ($2,250,000) 6
1919 in nonrecurring funds for each year of the 2025-2027 fiscal biennium to be awarded as directed 7
2020 grants in equal amounts to the following entities for the Fertility Preservation Pilot Program 8
2121 authorized by subsection (b) of this section: 9
2222 (1) Duke University School of Medicine's Onco-Fertility Program. 10
2323 (2) The University of North Carolina at Chapel Hill School of Medicine's Fertility 11
2424 Clinic/Fertility Preservation Program. 12
2525 (3) The Atrium Health Levine Cancer Center's REhope Cancer Fertility 13
2626 Treatment Program. 14
2727 SECTION 1.(b) There is established a Fertility Preservation Pilot Program 15
2828 (Program) for the period commencing July 1, 2025, and ending June 30, 2032. The purpose of 16
2929 the pilot program is to assist individuals whose future fertility is in jeopardy as a result of a cancer 17
3030 diagnosis or cancer treatment with obtaining any combination of in vitro fertilization (IVF) or 18
3131 intrauterine insemination (IUI) services; fertility preservation services; or fertility storage 19
3232 services, as appropriate. The pilot program shall be conducted by the three grantees specified in 20
3333 subsection (a) of this section. Each grantee shall establish an application process, eligibility 21
3434 criteria, and operating guidelines for their respective pilot program locations, subject to the 22
3535 following requirements and limitations: 23
3636 (1) An applicant who meets one or more of the following criteria is eligible to 24
3737 participate in the Program: 25
3838 a. Is uninsured. 26
3939 b. Has health insurance that does not provide comprehensive coverage 27
4040 for in vitro fertilization (IVF) or intrauterine insemination (IUI), for 28
4141 fertility preservation services, or for fertility storage services. 29
4242 c. Has health insurance that does provide comprehensive coverage for 30
4343 the services enumerated in sub-subdivision b. of this subdivision but 31
4444 would result in financial responsibility for the patient in excess of one 32
4545 thousand dollars ($1,000). 33
4646 d. Meets one or more of the criteria described in sub-subdivisions a. 34

4952 three hundred percent (300%) of the federal poverty level for a 1
5053 household of three. 2
5154 (2) The amount of financial assistance provided to Program participants shall not 3
5255 exceed any of the following: 4
5356 a. For female Program participants, a maximum of twelve thousand 5
5457 dollars ($12,000) for oocyte retrieval, cryopreservation, and up to five 6
5558 years of storage services. 7
5659 b. For male Program participants, a maximum of one thousand five 8
5760 hundred dollars ($1,500) for sperm retrieval, cryopreservation, and up 9
5861 to five years of storage services. 10
5962 c. A maximum of twenty-six thousand dollars ($26,000) per Program 11
6063 participant for IVF or IUI services, which must be scheduled for the 12
6164 Program participant within five years after oocyte or sperm retrieval. 13
6265 SECTION 1.(c) The grantees may use up to three percent (3%) of their directed 14
6366 grant funds for administrative costs associated with the Fertility Preservation Pilot Program 15
6467 authorized by this section. 16
6568 SECTION 1.(d) Each grantee may reserve up to twenty-six thousand dollars 17
6669 ($26,000) per applicant for future IVF or IUI services, as appropriate. However, funds shall not 18
6770 be reserved for IVF or IUI services scheduled more than five years after oocyte or sperm retrieval. 19
6871 SECTION 1.(e) Funds appropriated by subsection (a) of this section shall not revert 20
6972 at the end of the fiscal year but shall remain available until they are expended or June 30, 2032, 21
7073 whichever is earlier. 22
7174 SECTION 2. By February 1, 2028, and annually thereafter until February 1, 2033, 23
7275 each grantee shall submit a report to the Joint Legislative Commission on Governmental 24
7376 Operations, the Joint Legislative Oversight Committee on Health and Human Services, and the 25
7477 Fiscal Research Division that includes as least all of the following information in a format that 26
7578 complies with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and 27
7679 other pertinent federal and State laws governing privacy and security of confidential data and 28
7780 records: 29
7881 (1) An itemized list of expenditures. 30
7982 (2) The types of fertility treatment services, fertility preservation services, and 31
8083 fertility storage services funded by State appropriations, and the number of 32
8184 Program participants served with respect to each. 33
8285 (3) The amount of State appropriations held in reserve for future IVF or IUI 34
8386 services and the number of Program participants for whom these funds are 35
8487 being held in reserve. 36
8588 (4) An evaluation of the effectiveness and outcome of each service funded by 37
8689 State appropriations. 38
8790 SECTION 3. This act becomes effective July 1, 2025. 39
