1414 AN ACT TO PROHIBIT THE SALE OF TOBACCO PRODUCTS, ALTERNATIVE 2
1515 NICOTINE PRODUCTS, AND VAPOR PRODUCTS WITHIN ONE THOUSAND FEET 3

1717 The General Assembly of North Carolina enacts: 5
1818 SECTION 1. Article 52 of Chapter 14 of the General Statutes is amended by adding 6
1919 a new section to read: 7
2020 "ยง 14-401.28. Sale of tobacco products, alternative nicotine products, and vapor products 8
2121 near schools unlawful. 9
2222 (a) It is unlawful for any person, firm, or corporation in this State to sell or to purchase 10
2323 any tobacco products, alternative nicotine products, or vapor products at any of the following: 11
2424 (1) Any location which is within 1,000 feet of any property line of a property on 12
2525 which any public or nonpublic school is located. 13
2626 (2) Within any structure, any portion of which is within 1,000 feet of any property 14
2727 line of a property on which any public or nonpublic school is located. 15
2828 (b) As used in this section, the terms "tobacco products," "alternative nicotine products," 16
2929 and "vapor products" have the same meaning as defined in G.S. 14-313. As used in this section, 17
3030 "school" does not include home schools as defined in G.S. 115C-563 or institutions of higher 18
3131 education. 19
3232 (c) It shall not be a violation of this section to sell or purchase tobacco products, 20
3333 alternative nicotine products, or vapor products in a location prohibited by subsection (a) of this 21
3434 section if the sale or purchase of tobacco products, alternative nicotine products, or vapor 22
3535 products is incidental to the primary operations of an established business facility. 23
3636 (d) A violation of this section is a Class 2 misdemeanor." 24
3737 SECTION 2. This act becomes effective December 1, 2025, and applies to offenses 25
3838 committed on or after that date. 26
