1314 AN ACT TO MODIFY LAWS GOVERNING OPERATION OF MOPEDS. 2
1415 The General Assembly of North Carolina enacts: 3
1516 SECTION 1. G.S. 20-140.4 reads as rewritten: 4
1617 "§ 20-140.4. Special provisions for motorcycles and mopeds. 5
1718 (a) No person shall operate a motorcycle or moped upon a highway or public vehicular 6
1819 area: 7
1920 (1) When the number of persons upon or within such motorcycle or moped, 8
2021 including the operator, shall exceed the number of persons which it was 9
2122 designed to carry. For purposes of this subdivision, a moped is presumed to 10
2223 be designed for use by one person, unless the operator provides documentation 11
2324 from the manufacturer that indicates otherwise. 12

25-SECTION 2. G.S. 20-146 is amended by adding the following new subsection to 14

30-person may be cited for obstructing traffic if the person violates the provisions of this subsection." 19
31-SECTION 3. This act becomes effective December 1, 2025, and applies to offenses 20
32-committed on or after that date. 21
31+person who operates a moped in violation of this subsection shall have committed an infraction. 19
32+(g) No person shall operate a moped upon a highway where the posted speed limit is 20
