1414 AN ACT TO ESTABLISH THE CULTIVATION OF EXCELLENCE PILOT PROGRAM IN 2
1515 CLEVELAND COUNTY SCHOOLS. 3
1616 The General Assembly of North Carolina enacts: 4
1717 SECTION 1. Article 16 of Chapter 115C of the General Statutes is amended by 5
1818 adding a new Part to read: 6
1919 "Part 3B. Cultivation of Excellence Pilot Program. 7
2020 "ยง 115C-235. Cultivation of Excellence Pilot Program. 8
2121 (a) The General Assembly finds that the purpose of the Cultivation of Excellence Pilot 9
2222 Program is to provide the opportunity for the Cleveland County Board of Education to design 10
2323 and create an innovative and strategic vision to improve student achievement and performance, 11
2424 along with teacher recruitment and retention. Cleveland County Schools may participate in the 12
2525 Cultivation of Excellence Pilot Program beginning with the 2025-2026 school year and ending 13
2626 following the 2030-2031 school year. 14
2727 (b) Cleveland County Schools and the Cleveland County Board of Education may do the 15
2828 following: 16
2929 (1) Notwithstanding G.S. 115C-301(c), exercise flexibility in establishing 17
3030 staffing levels for kindergarten through third grade classes. 18
3131 (2) Notwithstanding G.S. 115C-295, employ individuals as teachers who do not 19
3232 hold a teacher license, subject to the following limitations: 20
3333 a. All teachers who are teaching in the core subject areas of mathematics, 21
3434 science, social studies, and language arts shall be college graduates. 22
3535 b. No more than fifty percent (50%) of the teachers at any school may be 23
3636 unlicensed. 24
3737 c. No more than twenty-five percent (25%) of all teachers employed by 25
3838 the Cleveland County Board of Education may be unlicensed. 26
3939 d. All individuals employed as teachers who do not hold a teaching 27
4040 license shall complete preservice training, which may be offered 28
4141 through an educator preparation program or through Cleveland County 29
4242 Schools, in all of the following areas prior to beginning instruction: 30
4343 1. The identification and education of children with disabilities. 31
4444 2. Positive management of student behavior. 32
4545 3. Effective communication for defusing and de-escalating 33
4646 disruptive or dangerous behavior. 34

4952 (3) Notwithstanding G.S. 110-85, G.S. 110-88, and any rule adopted pursuant to 1
5053 those statutes, employ any individual who meets the requirements for 2
5154 employment as a teaching assistant in a kindergarten classroom as a teacher 3
5255 assistant in the local school administrative unit's NC Prekindergarten (NC 4
5356 Pre-K) program. 5
5457 (4) Notwithstanding G.S. 115C-105.25(b)(3a) and (12), transfer and approve 6
5558 transfers of funds for the teacher assistants allotment category and textbooks 7
5659 and digital resources allotment category. 8
5760 (c) If the State Board determines that Cleveland County Schools has failed to meet 9
5861 generally accepted standards of fiscal management or violated State or federal law at any time, 10
5962 the State Board shall terminate participation in the pilot and shall submit, within 30 days of the 11
6063 termination, a report of the basis and evidence for the termination to the Joint Legislative 12
6164 Education Oversight Committee. 13
6265 (d) The Cleveland County Board of Education shall report no later than December 15 of 14
6366 each year of the Pilot Program to the Joint Legislative Education Oversight Committee and the 15
6467 Superintendent of Public Instruction. The report shall include the following: 16
6568 (1) Employment information as follows: 17
6669 a. The number of licensed and unlicensed teachers and use of long-term 18
6770 substitutes in filling vacancies for classroom teachers. 19
6871 b. Recruiting data on the number of licensed and unlicensed teachers 20
6972 hired during the school year. 21
7073 c. The number of NC Pre-K teaching assistants hired who meet the 22
7174 requirements for employment as a kindergarten teaching assistant. 23
7275 d. Overall employee retention in each school year. 24
7376 (2) Average class sizes in grades kindergarten through third grade. 25
7477 (3) An explanation of how flexibility in allotment categories was used. 26
7578 (4) An explanation as to how the flexibility granted by this section has contributed 27
7679 to student success over time, beginning with the 2024-2025 school year for 28
7780 comparison. 29
7881 (5) Any additional recommendations for the Cultivation of Excellence Pilot 30
7982 Program, including additional flexibilities that may contribute to student 31
8083 success." 32
8184 SECTION 2. Cleveland County Schools may submit a report to the Joint Legislative 33
8285 Education Oversight Committee and the Superintendent of Public Instruction by December 15, 34
8386 2026, on initial implementation of the Cultivation of Excellence Pilot Program and any 35
8487 recommended legislative changes. 36
8588 SECTION 3. It is the intent of the General Assembly to provide funding to Cleveland 37
8689 County Schools to implement a teacher compensation model and student behavior intervention 38
8790 programs for elementary and middle schools. 39
8891 SECTION 4. This act is effective when it becomes law and applies beginning with 40
8992 the 2025-2026 school year. Part 3B of Article 16 of Chapter 115C of the General Statutes, as 41
9093 enacted by this act, is repealed effective December 31, 2031. 42
