1514 AN ACT TO AUTHORIZE THE STATE LICENSING BOARD FOR GENERAL 2

1817 The General Assembly of North Carolina enacts: 5
1918 SECTION 1.(a) Article 1 of Chapter 87 of the General Statutes is amended by adding 6
2019 a new section to read: 7
2120 "§ 87-13.2. Board may refer violations for criminal prosecution. 8
2221 (a) Whenever the Board has reasonable grounds to believe that a person or entity has 9
2322 committed a violation of this Article that is subject to criminal penalty, the Board may refer the 10
2423 matter to the appropriate law enforcement agency or District Attorney for investigation and 11
2524 possible criminal prosecution. 12
2625 (b) Notwithstanding any confidentiality of investigative records that the Board holds, the 13
2726 Board may disclose such records to law enforcement agencies or prosecutors to facilitate 14
2827 investigation or prosecution of violations under this Article. 15
2928 (c) Nothing in this Article shall be construed to limit the Board's ability to assist in 16
3029 criminal prosecutions, including sharing information or using Board funds as authorized by this 17
3130 Article to support such prosecutions. 18
3231 (d) Nothing in this Article limits the power of the State to punish any person for any 19
3332 conduct that constitutes a crime under any other statute." 20
3433 SECTION 1.(b) Additional Rulemaking. – The State Licensing Board for General 21
3534 Contractors may adopt rules to implement the provisions of this section. 22
3635 SECTION 2. Effective Date. – This act is effective October 1, 2025, and applies to 23
3736 violations committed on or after that date. 24
