1414 AN ACT TO AMEND THE NORTH CAROLINA CONSTITUTION TO REPEAL THE 2
1515 LITERACY TEST REQUIREMENT . 3
1616 The General Assembly of North Carolina enacts: 4
1717 SECTION 1. Section 4 of Article VI of the North Carolina Constitution is repealed. 5
1818 SECTION 2. The amendment set out in Section 1 of this act shall be submitted to 6
1919 the qualified voters of the State at the statewide general election to be held on November 3, 2026, 7
2020 which election shall be conducted under the laws then governing elections in the State. Ballots, 8
2121 voting systems, or both may be used in accordance with Chapter 163 of the General Statutes. The 9
2222 question to be used in the voting systems and ballots shall be: 10
2323 "[ ] FOR [ ] AGAINST 11
2424 Constitutional amendment to remove the literacy test requirement for voting from the 12
2525 North Carolina Constitution. The federal Voting Rights Act of 1965 prohibits implementation of 13
2626 this requirement." 14
2727 SECTION 3. The State Board of Elections shall certify the results of the referendum 15
2828 conducted under Section 2 of this act. If a majority of votes cast on the question are in favor of 16
2929 the amendment set out in Section 1 of this act, the Secretary of State shall enroll the amendment 17
3030 among the permanent records of that office. If a majority of votes cast on the question are against 18
3131 the amendment set out in Section 1 of this act, the amendment shall have no effect. 19
3232 SECTION 4. If the certification from the State Board of Elections under Section 3 20
3333 of this act reflects that a majority of votes cast on the question are in favor of the amendment set 21
3434 out in Section 1 of this act, the amendment set out in Section 1 of this act is effective upon 22
3535 certification. 23
3636 SECTION 5. Except as otherwise provided, this act is effective when it becomes 24
3737 law. 25
