16 | 16 | | The General Assembly of North Carolina enacts: 4 |

17 | 17 | | SECTION 1. The Legislative Research Commission (LRC) shall study the abolition 5 |
---|
18 | 18 | | of contributory negligence in this State. As part of the study, the LRC shall do all of the following: 6 |
---|
19 | 19 | | (1) Determine whether the abolition of contributory negligence would improve 7 |
---|
20 | 20 | | measure outcomes for the citizens of this State. 8 |
---|
21 | 21 | | (2) Determine whether maintaining contributory negligence is harming citizens, 9 |
---|
22 | 22 | | and in what primary ways. 10 |
---|
23 | 23 | | (3) Evaluate the fiscal impacts of the adoption of a new negligence framework, 11 |
---|
24 | 24 | | including costs to individuals, consumers, businesses, insurance, and other 12 |
---|
25 | 25 | | appropriate areas. 13 |
---|
26 | 26 | | (4) Make a recommendation as to what negligence framework would be most 14 |
---|
27 | 27 | | beneficial to the State, including modified and pure comparative negligence. 15 |
---|
28 | 28 | | SECTION 2. The LRC shall submit a report on its study, including any legislative 16 |
---|
29 | 29 | | recommendations, to the 2026 Regular Session of the 2025 General Assembly upon its 17 |
---|
30 | 30 | | convening. 18 |
---|
31 | 31 | | SECTION 3. This act is effective when it becomes law. 19 |
