1414 AN ACT TO DIRECT THE LEGISLATIVE RESEARCH COMMISSION TO STUDY THE 2
1515 ABOLITION OF CONTRIBUTORY NEGLIGENCE. 3
1616 The General Assembly of North Carolina enacts: 4
1717 SECTION 1. The Legislative Research Commission (LRC) shall study the abolition 5
1818 of contributory negligence in this State. As part of the study, the LRC shall do all of the following: 6
1919 (1) Determine whether the abolition of contributory negligence would improve 7
2020 measure outcomes for the citizens of this State. 8
2121 (2) Determine whether maintaining contributory negligence is harming citizens, 9
2222 and in what primary ways. 10
2323 (3) Evaluate the fiscal impacts of the adoption of a new negligence framework, 11
2424 including costs to individuals, consumers, businesses, insurance, and other 12
2525 appropriate areas. 13
2626 (4) Make a recommendation as to what negligence framework would be most 14
2727 beneficial to the State, including modified and pure comparative negligence. 15
2828 SECTION 2. The LRC shall submit a report on its study, including any legislative 16
2929 recommendations, to the 2026 Regular Session of the 2025 General Assembly upon its 17
3030 convening. 18
3131 SECTION 3. This act is effective when it becomes law. 19
