1314 AN ACT TO REQUIRE THE USE OF ZERO-BASED BUDGETING FOR STATE AGENCIES 2
1415 ON A ROTATING BASIS. 3
1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1. Article 3 of Chapter 143C of the General Statutes is amended by adding 5
1718 a new section to read: 6
1819 "ยง 143C-3-3.1. Zero-based budgeting estimates. 7
1920 (a) Commencing with the fiscal year beginning July 1, 2025, in each even-numbered year 8
2021 each State agency of the executive branch designated in a scheduled year, as described in 9
2122 subsection (e) of this section, shall prepare and submit to the Office of State Budget and 10
2223 Management (OSBM) a zero-based budget plan for the fiscal biennium beginning July 1 of the 11
2324 following fiscal year. OSBM shall provide technical assistance to support each State agency in 12
2425 completing its zero-based budget plan. For purposes of this section, the term "zero-based budget" 13
2526 means a budget that reflects the amount of funding deemed necessary to achieve the most 14
2627 cost-effective performance of a State agency pursuant to an accompanying narrative delineating 15
2728 the tasks to be performed by the State agency together with the goals and objectives for the State 16
2829 agency for a period not to exceed two years. The budget shall have a zero dollar amount as its 17
2930 basis and shall not reflect any prior appropriation amount, adjusted or otherwise. 18
3031 (b) At a minimum, a State agency's plan shall contain the following information: 19
3132 (1) A description of those discrete activities that comprise the agency, and a 20
3233 justification for the existence of each activity by reference to statute or other 21
3334 legal authority. 22
3435 (2) For each activity, a quantitative estimate of any adverse impacts that could 23
3536 reasonably be expected should the activity be discontinued, together with a 24
3637 full description of the methods by which the adverse impact is estimated. 25
3738 (3) A list of quantifiable program outcomes that measure the efficiency and 26
3839 effectiveness of each program. 27
3940 (4) For each activity, an itemized account of expenditures that would be required 28
4041 to maintain the activity at the minimum level of service required by the 29
4142 statutory authority, together with a concise statement of the quantity and 30
4243 quality of services required at that minimum level. 31
4344 (5) For each activity, an itemized account of expenditures required to maintain 32
4445 the activity at current levels of service, together with a concise statement of 33
4546 the quantity and quality of services being provided. 34
4647 (6) A ranking of all activities that shows the relative contribution of each activity 35

4954 (c) OSBM shall submit the zero-based budget plans for those State agencies required to 1
5055 prepare plans pursuant to the schedule set forth in subsection (e) of this section no later than 2
5156 when the Governor presents budget recommendations to the General Assembly under 3
5257 G.S. 143C-3-5. 4
5358 (d) All statutory appropriations, as defined in G.S. 143C-1-1(d), shall be excluded from 5
5459 any zero-based budgeting plans. 6
5560 (e) State agencies shall submit zero-based budget plans pursuant to the following 7
5661 schedule: 8
5762 (1) In 2025, and every eight years thereafter, for the following Divisions within 9
5863 the Department of Health and Human Services: 10
5964 a. Aging and Adult Services. 11
6065 b. Child and Family Well-Being. 12
6166 c. Employment and Independence for People with Disabilities. 13
6267 d. Health Benefits. 14
6368 e. Health Service Regulation. 15
6469 f. Services for the Blind. 16
6570 g. Services for the Deaf and Hard of Hearing. 17
6671 (2) In 2027, and every eight years thereafter, for the following agencies: 18
6772 a. Divisions within the Department of Health and Human Services as 19
6873 follows: 20
6974 1. Central Management and Support. 21
7075 2. Child Development and Early Education. 22
7176 3. Mental Health, Developmental Disabilities, and Substance Use 23
7277 Services. 24
7378 4. Public Health. 25
7479 5. Social Services. 26
7580 b. Department of Public Instruction. 27
7681 (3) In 2029, and every eight years thereafter, for the following agencies: 28
7782 a. Office of Administrative Hearings. 29

104109 SECTION 2. This act is effective when it becomes law. 4
