13-AN ACT TO ESTABLISH A CRIMINAL OFFENSE F OR POSSESSING CERTAI N 2
14-EXPLOSIVE OR INCENDIARY DEVICES OR MATERIAL. 3
15-The General Assembly of North Carolina enacts: 4
16-SECTION 1. G.S. 14-49 reads as rewritten: 5
17-"§ 14-49. Malicious use of explosive or incendiary; punishment. 6
18-(a) Any person who willfully and maliciously injures another by the use of any explosive 7
19-or incendiary device or material is guilty of a Class D felony. 8
20-(b) Any person who willfully and maliciously damages any real or personal property of 9
21-any kind or nature belonging to another by the use of any explosive or incendiary device or 10
22-material is guilty of a Class G felony. 11
23-(b1) Any person who willfully and maliciously damages, aids, counsels, or procures the 12
24-damaging of any church, chapel, synagogue, mosque, masjid, or other building of worship by the 13
25-use of any explosive or incendiary device or material is guilty of a Class E felony. 14
26-(b2) Any person who willfully and maliciously damages, aids, counsels, or procures the 15
27-damaging of the State Capitol, the Legislative Building, the Justice Building, or any building 16
28-owned or occupied by the State or any of its agencies, institutions, or subdivisions or by any 17
29-county, incorporated city or town, or other governmental entity by the use of any explosive or 18
30-incendiary device or material is guilty of a Class E felony. 19
31-(c) Repealed by Session Laws 1993, c. 539, s. 1149, effective October 1, 1994. 20
32-(d) Any person who possesses any explosive or incendiary device or material with the 21
33-intent to violate this section is guilty of a Class H felony." 22
34-SECTION 2. This act becomes effective December 1, 2025, and applies to offenses 23
35-committed on or after that date. 24
