1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1. G.S. 58-33-30 reads as rewritten: 5

2122 (d) Education and Training. – 10
2223 (1) Each applicant must have had special education, training, or 11
2324 experience of sufficient duration and extent reasonably to satisfy the 12
2425 Commissioner that the applicant possesses the competence necessary 13
2526 to fulfill the responsibilities of an insurance producer, limited 14
2627 representative, adjuster, or motor vehicle damage appraiser. The 15
2728 Commissioner shall not require an individual who applies for an 16
2829 insurance producer license in this State to complete any specific 17
2930 amount of instruction or any specific course of instruction. 18
3031 (2) All individual applicants for licensing as insurance producers under 19
3132 G.S. 58-33-26(c1)(1), (2), (4), (6), or (7) shall furnish evidence 20
3233 satisfactory to the Commissioner of successful completion of at least 21
3334 20 hours of instruction for each license, which shall in all cases include 22
3435 the general principles of insurance and any other topics relevant to the 23
3536 license that the Commissioner establishes by administrative rules. Any 24
3637 applicant who submits satisfactory evidence of having successfully 25
3738 completed a producer training course that has been approved by the 26
3839 Commissioner and that is offered by or under the auspices of a 27
3940 property, casualty, life or accident and health or sickness insurance 28
4041 company admitted to do business in this State or a professional 29
4142 insurance association shall be deemed to have satisfied the educational 30
4243 requirements of this subdivision.Any producer training course 31
4344 developed for the purpose of preparing an applicant for the 32
4445 examination required by subsection (e) of this section must be 33
4546 approved by the Commissioner. 34
4647 (3) Each resident applicant for a Medicare supplement and long-term care 35

6065 (5) The Commissioner shall collect in advance the examination and 12
6166 registration fees provided in G.S. 58-33-125 and in subsection 13
6267 subdivision (4) of this section. subsection. The Commissioner shall 14
6368 make or cause to be made available to all applicants, for a reasonable 15
6469 fee to offset the costs of production, materials that he considers 16
6570 necessary for the applicants' proper preparation for examinations. The 17
6671 Commissioner may contract directly with publishers and other 18
6772 suppliers for the production of the preparatory materials, and contracts 19
6873 so let by the Commissioner shall not be subject to Article 3 of Chapter 20
6974 143 of the General Statutes. However, the Commissioner shall: (i) 21
7075 submit all proposed contracts for supplies, materials, printing, 22
7176 equipment, and contractual services that exceed one million dollars 23
7277 ($1,000,000) authorized by this subdivision to the Attorney General or 24
7378 the Attorney General's designee for review as provided in 25
7479 G.S. 114-8.3; and (ii) include in all contracts to be awarded by the 26
7580 Commissioner under this subdivision a standard clause which provides 27
7681 that the State Auditor and internal auditors of the Commissioner may 28
7782 audit the records of the contractor during and after the term of the 29
7883 contract to verify accounts and data affecting fees and performance. 30
7984 The Commissioner shall not award a cost plus percentage of cost 31
