16 | 17 | | SECTION 1. Section 2.4 of S.L. 2023-7 reads as rewritten: 5 |

17 | 18 | | "SECTION 2.4. If there is any indication that work requirements as a condition of 6 |

18 | 19 | | participation in the Medicaid program may be authorized by the Centers for Medicare and 7 |
---|
19 | 20 | | Medicaid Services (CMS), then the Department of Health and Human Services, Division of 8 |
---|
20 | 21 | | Health Benefits (DHB), shall enter into negotiations with CMS to develop a plan for those work 9 |
---|
21 | 22 | | requirements and to obtain approval of that plan. Within 30 days of entering into negotiations 10 |
---|
22 | 23 | | with CMS pursuant to this section, DHB shall notify, in writing, the Joint Legislative Oversight 11 |
---|
23 | 24 | | Committee on Medicaid (JLOC) and the Fiscal Research Division (FRD) of these negotiations. 12 |

24 | 25 | | Within 30 days of approval by CMS of a plan for work requirements as a condition of 13 |

25 | 26 | | participation in the Medicaid program, DHB shall submit a report to JLOC and FRD containing 14 |

26 | 27 | | the full details of the approved work requirements, including the approved date of 15 |

27 | 28 | | implementation of the requirements and any funding necessary to implement or maintain the 16 |

28 | 29 | | requirements. Notwithstanding any provision of G.S. 108A-54.3A to the contrary, the 17 |

29 | 30 | | Department of Health and Human Services shall implement any work requirements as a condition 18 |
---|
30 | 31 | | of participation in the Medicaid program approved by the Centers for Medicare and Medicaid 19 |
---|
31 | 32 | | Services in accordance with this section." 20 |
