1314 AN ACT TO PROHIBIT THE SALE OR POSSESSION OF GHOST GUNS AND 2
1415 UNDETECTABLE FIREARMS . 3
1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1. Article 52A of Chapter 14 of the General Statutes is amended by 5
1718 adding a new section to read: 6
1819 "§ 14-409B. Ghost guns and undetectable firearms prohibited. 7
1920 (a) Definition. – The following definitions apply in this section: 8
2021 (1) Ghost gun. – A firearm, including a frame or receiver, that lacks a unique 9
2122 serial number engraved or cased in metal alloy on the frame or receiver by a 10
2223 licensed manufacturer, maker, or importer under federal law or markings in 11
2324 accordance with 27 C.F.R. § 479.102. This term does not include a firearm 12
2425 that has been rendered permanently inoperable or a firearm that is not required 13
2526 to have a serial number in accordance with the federal Gun Control Act of 14
2627 1968. 15
2728 (2) Undetectable firearm. – A firearm that satisfies any of the following 16
2829 requirements: 17
2930 a. After removal of all parts, other than a major component, is not as 18
3031 detectable by walk-through metal detectors commonly used at airports 19
3132 or other public buildings. 20
3233 b. Any major component of which, if subjected to inspection by the types 21
3334 of detection devices commonly used at airports or other public 22
3435 buildings for security screening, would not generate an image that 23
3536 accurately depicts the shape of the component. 24
3637 c. Is manufactured wholly of plastic, fiberglass, or through a 3D printing 25
3738 process. 26
3839 (b) Prohibition. – Except as otherwise provided in subsection (c) of this section, it shall 27
3940 be unlawful for any person, firm, or corporation to manufacture, sell, give away, transfer, use, or 28
4041 possess a ghost gun or an undetectable firearm. 29
4142 (c) Exception. – This section does not apply to federally licensed firearm manufacturers 30
4243 (Federal Firearm License Type 07) pursuant to Alcohol, Tobacco, Firearms, and Explosives 31
4344 (ATF) regulations. 32
4445 (d) Punishment. – Any person violating this section is guilty of a Class I felony." 33
4546 SECTION 2. This act becomes effective December 1, 2025, and applies to offenses 34
4647 committed on or after that date. 35
