Referred to: Rules and Operations of the Senate March 25, 2025 *S443 -v-1* A BILL TO BE ENTITLED 1 AN ACT PROVIDING THA T COUNTIES AND CITIES SHALL REQUIRE BENE FIT 2 PROVIDERS TO SUBMIT AN ANNUAL COMPENSATI ON DISCLOSURE. 3 The General Assembly of North Carolina enacts: 4 SECTION 1. Article 23 of Chapter 153A of the General Statutes is amended by 5 adding a new section to read: 6 "§ 153A-466. Compensation paid to benefit providers. 7 Each provider of life, health, or other insurance, or other fringe benefits, including voluntary 8 benefits, to county employees, dependents of county employees, or persons retired from county 9 employment shall, on an annual basis, submit to the county a full compensation disclosure of all 10 funds paid to the provider by the county. For purposes of this section, the term "provider" 11 includes, but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy 12 benefits manager, and insurance company. The compensation disclosure shall include all of the 13 following: 14 (1) All income paid, directly or indirectly, to the provider, including, but not 15 limited to, commissions, bonuses, fees, including fees for consulting or 16 administrative services, and management compensation for shared risk 17 arrangements in which the county participated for life, health, and other fringe 18 benefits, including voluntary benefits. 19 (2) An affirmation that none of the compensation paid by the county has been 20 provided to any county employee or elected official, directly or indirectly." 21 SECTION 2. Article 21 of Chapter 160A of the General Statutes is amended by 22 adding a new section to read: 23 "§ 160A-485.1. Compensation paid to benefit providers. 24 Each provider of life, health, or other insurance, or other fringe benefits, including voluntary 25 benefits, to city employees, dependents of city employees, or persons retired from city 26 employment shall, on an annual basis, submit to the city a full compensation disclosure of all 27 funds paid to the provider by the city. For purposes of this section, the term "provider" includes, 28 but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy benefits 29 manager, and insurance company.
