1314 AN ACT PROVIDING THAT COUNTIES AND CITIES SHALL REQUIRE BENEFIT 2
1415 PROVIDERS TO SUBMIT AN ANNUAL COMPENSATION DISC LOSURE. 3
1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1. Article 23 of Chapter 153A of the General Statutes is amended by 5
1718 adding a new section to read: 6
1819 "§ 153A-466. Compensation paid to benefit providers. 7
1920 Each provider of life, health, or other insurance, or other fringe benefits, including voluntary 8
2021 benefits, to county employees, dependents of county employees, or persons retired from county 9
2122 employment shall, on an annual basis, submit to the county a full compensation disclosure of all 10
2223 funds paid to the provider by the county. For purposes of this section, the term "provider" 11
2324 includes, but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy 12
2425 benefits manager, and insurance company. The compensation disclosure shall include all of the 13
2526 following: 14
2627 (1) All income paid, directly or indirectly, to the provider, including, but not 15
2728 limited to, commissions, bonuses, fees, including fees for consulting or 16
2829 administrative services, and management compensation for shared risk 17
2930 arrangements in which the county participated for life, health, and other fringe 18
3031 benefits, including voluntary benefits. 19
3132 (2) An affirmation that none of the compensation paid by the county has been 20
3233 provided to any county employee or elected official, directly or indirectly." 21
3334 SECTION 2. Article 21 of Chapter 160A of the General Statutes is amended by 22
3435 adding a new section to read: 23
3536 "§ 160A-485.1. Compensation paid to benefit providers. 24
3637 Each provider of life, health, or other insurance, or other fringe benefits, including voluntary 25
3738 benefits, to city employees, dependents of city employees, or persons retired from city 26
3839 employment shall, on an annual basis, submit to the city a full compensation disclosure of all 27
3940 funds paid to the provider by the city. For purposes of this section, the term "provider" includes, 28
4041 but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy benefits 29
4142 manager, and insurance company. The compensation disclosure shall include all of the following: 30
4243 (1) All income paid, directly or indirectly, to the provider, including, but not 31
