18 | 19 | | SECTION 1. G.S. 143-213 is amended by adding a new subdivision to read: 7 |

19 | 20 | | "(5b) The term "atmospheric modification" means stratospheric aerosol injection 8 |

20 | 21 | | (SAI), cloud seeding, electromagnetic radio frequency or microwave radiation 9 |

21 | 22 | | emissions, or other atmospheric polluting activity affecting temperature, 10 |

22 | 23 | | weather, intensity of sunlight, the environment, agriculture, wildlife, human 11 |

23 | 24 | | health and safety, aviation, state security, or the economy of the State. The 12 |

24 | 25 | | term does not include the application of pesticides via aircraft under a license 13 |

25 | 26 | | issued by the Pesticide Board pursuant to Article 52 of this Chapter." 14 |

26 | 27 | | SECTION 2. G.S. 143-215.108(a) is amended by adding a new subdivision to read: 15 |

27 | 28 | | "(5) Intentionally inject, release, or disperse, by any means, chemicals, chemical 16 |

28 | 29 | | compounds, substances, or apparatus within the borders of this State into the 17 |
---|
29 | 30 | | atmosphere with the intentional and sole purpose of atmospheric 18 |
---|
30 | 31 | | modification." 19 |

31 | 32 | | SECTION 3. The Environmental Management Commission shall adopt rules 20 |

32 | 33 | | necessary to implement this act. 21 |

33 | 34 | | SECTION 4. This act is effective when it becomes law. 22 |
