1314 AN ACT TO ADJUST MEDICAID RATES PAID TO AMBULATORY SURGICAL 2

1516 The General Assembly of North Carolina enacts: 4
1617 SECTION 1. The Department of Health and Human Services, Division of Health 5
1718 Benefits, shall amend the Medicaid State Plan to set and adjust rates for all services provided by 6
1819 licensed ambulatory surgical centers so that these services are reimbursed at a rate of at least 7
1920 ninety-five percent (95%) of the Medicare Ambulatory Surgical Centers fee schedule in effect as 8
2021 of January 1 of each year, as published by the Centers for Medicare and Medicaid Services 9
2122 (CMS). The initial rate adjustments shall be effective on the effective date approved by CMS for 10
2223 the State Plan amendment. 11
2324 SECTION 2. There is appropriated from the General Fund to the Department of 12
2425 Health and Human Services, Division of Health Benefits, the sum of six million nine hundred 13
2526 sixteen thousand dollars ($6,916,000) in recurring funds for each year of the 2025-2027 fiscal 14
2627 biennium to be used to implement the changes required under this act. These funds shall provide 15
2728 a State match for twelve million six hundred thirty-three thousand dollars ($12,633,000) in 16
2829 recurring federal funds for each year of the 2025-2027 fiscal biennium, and those funds are 17
2930 appropriated to the Division of Health Benefits for this same purpose. 18
3031 SECTION 3. This act is effective July 1, 2025. 19
