15 | 16 | | The General Assembly of North Carolina enacts: 4 |

16 | 17 | | SECTION 1. The Department of Health and Human Services, Division of Health 5 |

17 | 18 | | Benefits, shall amend the Medicaid State Plan to set and adjust rates for all services provided by 6 |

18 | 19 | | licensed ambulatory surgical centers so that these services are reimbursed at a rate of at least 7 |
---|
19 | 20 | | ninety-five percent (95%) of the Medicare Ambulatory Surgical Centers fee schedule in effect as 8 |

20 | 21 | | of January 1 of each year, as published by the Centers for Medicare and Medicaid Services 9 |

21 | 22 | | (CMS). The initial rate adjustments shall be effective on the effective date approved by CMS for 10 |

22 | 23 | | the State Plan amendment. 11 |

23 | 24 | | SECTION 2. There is appropriated from the General Fund to the Department of 12 |

24 | 25 | | Health and Human Services, Division of Health Benefits, the sum of six million nine hundred 13 |

25 | 26 | | sixteen thousand dollars ($6,916,000) in recurring funds for each year of the 2025-2027 fiscal 14 |

26 | 27 | | biennium to be used to implement the changes required under this act. These funds shall provide 15 |
---|
27 | 28 | | a State match for twelve million six hundred thirty-three thousand dollars ($12,633,000) in 16 |
---|
28 | 29 | | recurring federal funds for each year of the 2025-2027 fiscal biennium, and those funds are 17 |
---|
29 | 30 | | appropriated to the Division of Health Benefits for this same purpose. 18 |

30 | 31 | | SECTION 3. This act is effective July 1, 2025. 19 |
