1314 AN ACT AMENDING THE CHARTER OF THE TOWN OF GARNER TO ALLOW THE 2
1415 TOWN COUNCIL TO DELEGATE TO THE TOWN MANAGER THE POWER TO 3
1516 SETTLE CERTAIN CLAIMS AGAINST THE TOWN. 4
1617 The General Assembly of North Carolina enacts: 5
1718 SECTION 1. Section 6.2 of the Charter of the Town of Garner, being Chapter 333 6
1819 of the Session Laws of 1977, as amended, reads as rewritten: 7
1920 "Sec. 6.2. Settlement of claims. (a) The board of aldermen town council may authorize the 8
2021 town manager to settle the following claims against the town for personal town: 9
2122 (1) Personal injury or damage to property when the amount involved does not 10
2223 exceed the sum of one hundred dollars ($100.00) ten thousand dollars 11
2324 ($10,000) and does not exceed the actual loss sustained, including loss of time, 12
2425 medical expenses, and any other expense actually incurred. 13
2526 (2) Eminent domain cases filed by the town when the amount involved does not 14
2627 exceed the amount budgeted for property or easement acquisition for the 15
2728 approved capital improvement program. 16
2829 (3) Claims made by the town or debts owed to the town when the amount involved 17
2930 does not exceed the sum of ten thousand dollars ($10,000). 18
3031 (b) All such settlements shall be approved by the town attorney.attorney and reported to the 19
3132 town council in a timely manner. Settlement of a claim by the town manager pursuant to this 20
3233 section shall constitute a complete release of the town from any and all damages sustained by the 21
3334 person involved in such settlement in any manner arising out of the incident, occasion, or taking 22
3435 complained of." 23
3536 SECTION 2. This act is effective when it becomes law. 24
