8	10		BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9		-	SECTION 1. AMENDMENT. Section 50-29-04 of the North Dakota Century Code is ~~amended and~~
10		-	reenacted as follows:

	12	+	amended and reenacted as follows:
11	13		50-29-04. Plan requirements.
12	14		The plan:
13		-	1.Must be consistent with coverage provided to children eligible for medical assistance ~~in the~~
14		-	state; and
	15	+	1.Must be consistent with coverage provided to children eligible for medical assistance
	16	+	in the state; and
15	17		2.Must provide:
16		-	a.A modified adjusted gross income eligibility limit of two hundred tentwo hundred ~~five~~
17		-	percent of the poverty line; and
	18	+	a.A modified adjusted gross income eligibility limit of two hundred tentwo hundred
	19	+	five percent of the poverty line; and
18	20		b.Current eligibility may be established from the first day of the month in which the
19		-	application was received. Retroactive eligibility may be established for the three calendar
20		-	months that immediately preceded the month in which the application was received even
21		-	if there is no eligibility in the month of application. Eligibility can be established if all
