810 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9-SECTION 1. DEPARTMENT OF EMERGENCY SERVICES - FOREIGN ADVERSARY THREAT

12+THREAT ASSESSMENT - REPORT - LEGISLATIVE MANAGEMENT REPORT.
1113 1.The department of emergency services shall:
12-a.Identify sectors and industries most vulnerable to foreign adversarial influence, including
13-critical infrastructure, technology, agriculture, energy, and academia;
14+a.Identify sectors and industries most vulnerable to foreign adversarial influence,
15+including critical infrastructure, technology, agriculture, energy, and academia;
1416 b.Assess foreign adversarial influence beyond land acquisition, including strategic
15-investments, partnerships, and other forms of economic, educational, and political
16-influence;
17-c.Evaluate existing investments and activities to determine compliance with federal, state,
18-and local laws;
19-d.Identify sectors in which foreign adversarial influence is often unmonitored or under
20-reported; and
21-e.Propose broad mitigation strategies relating to identified risks and vulnerabilities to
22-enhance the state's ability to manage foreign adversarial influence while supporting
23-economic growth and security.
24-2.By July 1, 2026, the department of emergency services shall produce a written report outlining
25-its findings and recommendations. The report must:
26-a.Provide a detailed analysis of the foreign adversary threats and vulnerabilities specific to
27-the state;
28-b.Identify critical risks across sectors, including infrastructure, security, academia, and
29-economic investments;
30-c.Provide sector specific mitigation recommendations designed to reduce vulnerabilities in
31-infrastructure, academic institutions, economic investments, and other prominent sectors
32-in the state; and
33-d.Include a proposal providing for the establishment of a state intelligence unit and the
34-structure, roles, and operational procedures required for continuous monitoring of foreign
35-adversary threats by the state intelligence unit.

3665 3.Before September 1, 2026, the department of emergency services shall present the
37-recommendations in the report under subsection 2, and any proposed legislation necessary to
38-implement the recommendations, to the legislative management. The findings in the report
39-must remain in the exclusive possession and under the control of the department of
