12+A BILL for an Act to amend and reenact section 12.1-31-15 of the North Dakota Century Code,

814 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9-SECTION 1. AMENDMENT. Section 12.1-31-15 of the North Dakota Century Code is amended and
10-reenacted as follows:

16+amended and reenacted as follows:
1117 12.1-31-15. Wearing of masks during commission of criminal offense prohibited.
12-1.An individual may not wear a mask, hood, or other device that covers, hides, or conceals any
13-portion of that individual's face:
18+1.An individual may not wear a mask, hood, or other device that covers, hides, or
19+conceals any portion of that individual's face:
1420 a.With the intent to intimidate, threaten, abuse, or harass any other individual;
15-b.For the purpose of evading or escaping discovery, recognition, or identification during the
16-commission of a criminal offense; or
17-c.For the purpose of concealment, flight, or escape when the individual has been charged
18-with, arrested for, or convicted of a criminal offense.; or
19-d.With the intent to conceal the identity of the individual while congregating in a public
20-place with other individuals wearing a mask, hood, or other device that covers, hides, or
21-conceals any portion of the individual's face.
22-2.Subdivision d of subsection 1 does not apply to public gatherings to celebrate Halloween, a
23-masquerade, or other similar celebration.
