8	8	A BILL for an Act to amend and reenact section 54-44.3-20 of the North Dakota Century Code,
9	9	relating to exemptions from the employee classification system; and to repeal section
10	10	54-52.5-04 of the North Dakota Century Code, relating to an incentive compensation plan for
11	11	the state retirement and investment office.
12	12	BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
13	13	SECTION 1. AMENDMENT. Section 54-44.3-20 of the North Dakota Century Code is
14	14	amended and reenacted as follows:
15	15	54-44.3-20. Categories of positions in the state service.
16	16	All positions in the state service are included in the classified service, except:
17	17	1.Each official elected by popular vote and each person appointed to fill vacancies in an
18	18	elective office, one principal assistant, and one private secretary.
19	19	2.Members of boards and commissions required by law.
20	20	3.Administrative heads of departments required by law, other than the superintendent of
21	21	the life skills and transition center, the superintendent of North Dakota vision services -
22	22	school for the blind, the superintendent of the school for the deaf, and the state
23	23	librarian.
24	24	4.Officers and employees of the legislative branch of government.
25	25	5.Members of the judicial branch of government of the state of North Dakota and their
26	26	employees and jurors.
27	27	6.Persons temporarily employed in a professional or scientific capacity as consultants or
28	28	to conduct a temporary and special inquiry, investigation, or examination for the
29	29	legislative branch of government or a department of the state government.
30	30	7.Positions deemed to be inappropriate to the classified service due to the special
31	31	nature of the position as determined by the division and approved by the board.
