77 A BILL for an Act to create and enact a new subdivision to subsection 2 of section 39-06.1-06 of
88 the North Dakota Century Code, relating to the amount of statutory fees; to amend and reenact
99 sections 39-04-08 and 39-04-11 of the North Dakota Century Code, relating to number plates;
1010 and to provide a penalty.
1111 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
1212 SECTION 1. AMENDMENT. Section 39-04-08 of the North Dakota Century Code is
1313 amended and reenacted as follows:
1414 39-04-08. Number plates furnished by the department.
1515 1.The department shall furnish:
1616 a.Two number plates to every motor vehicle owner two number plates for each
1717 registered motor vehicle, and one;
1818 b.One number plate to every motor vehicle owner for each registered motor vehicle
1919 upon request of the registered motor vehicle owner and payment of an additional
2020 fee of one hundred twenty - five dollars; or
2121 c.One number plate for each registered motorcycle, trailer, or housetrailer.
2222 2.The department may, in its discretion, furnish only one number plate for each
2323 registered apportioned vehicle licensed under the international registration plan as
2424 authorized in section 39-19-04, truck tractor, or semitrailer.
2525 SECTION 2. AMENDMENT. Section 39-04-11 of the North Dakota Century Code is
2626 amended and reenacted as follows:
2727 39-04-11. Display of number plates and tabs.
2828 1.Unless otherwise provided by law, an individual may not operate a vehicle on a public
2929 highway of this state unless the vehicle has a distinctive number assigned to the
3030 vehicle by the department, and two number plates, bearing the distinctive number

5959 conspicuously displayed, horizontally and in an upright position, one on the front and
6060 one on the rear of the vehicle, each securely fastened, except number plates assigned
6161 to a housetrailer must be attached to the rear of the housetrailer.
6262 2.An individual may operate a vehicle on a public road with only one number plate
6363 displayed on the rear of the vehicle if the registered owner pays the additional fee
6464 under subdivision b of section 39 - 04 - 08.
6565 3.Number plates assigned to a motorcycle or trailer must be attached to the rear of the
6666 motorcycle or trailer and may be displayed vertically.
6767 4.When only one number plate is furnished for an apportioned vehicle registered under
6868 the international registration plan as authorized in section 39-19-04, truck tractor, or
6969 semitrailer, the plate must be attached to the front of the apportioned vehicle or truck
7070 tractor and the rear of the semitrailer. The bottom of each number plate must be at a
7171 height of not less than twelve inches [30.48 centimeters] above the level surface upon
7272 which the vehicle stands. Each plate must be mounted in a visible manner that clearly
7373 displays the distinctive number assigned to the vehicle and the name of the state on
7474 the plate.
7575 5.As far as is reasonably possible, the platesa plate must at all times be kept free and
7676 clear of mud, ice, or snow so as to be clearly visible and all number plates, markers, or
7777 evidence of registration or licensing except for the current year must be removed from
7878 the vehicle. All vehicle licensenumber plates issued by the department are the
7979 property of the department for the period for which the plates are valid. An annual
8080 registration tab or sticker for the current registration year must be displayed on each
8181 number plate, in the area designated by the department for the tab or sticker, in those
8282 years for which tabs or stickers are issued in lieu of number plates.
8383 SECTION 3. A new subdivision to subsection 2 of section 39-06.1-06 of the North Dakota
8484 Century Code is created and enacted as follows:
8585 A violation of section 39 - 04 - 11, a fee of two hundred dollars.
