814 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9-SECTION 1. AMENDMENT. Section 23-27-01 of the North Dakota Century Code is amended and
10-reenacted as follows:
15+SECTION 1. AMENDMENT. Section 23-27-01 of the North Dakota Century Code is
16+amended and reenacted as follows:
1117 23-27-01. License required - Licensing of emergency medical services operations -
1218 Exception - Waiver.
13-1.The department of health and human services shall license emergency medical services
14-operations and may designate their service areas. The department shall limit the issuance of a
15-license for any new emergency medical services operation based on the needs of the service
16-area. A license for an emergency medical services operation is nontransferabletransferable
17-upon approval of the department.
18-2.Emergency medical services may not be advertised, offered, or provided to the public except
19-by an emergency medical services operator that provides the emergency medical services
20-through emergency medical services personnel.
19+1.The department of health and human services shall license emergency medical
20+services operations and may designate their service areas. The department shall limit
21+the issuance of a license for any new emergency medical services operation based on
22+the needs of the service area. A license for an emergency medical services operation
23+is nontransferabletransferable upon approval of the department.
24+2.Emergency medical services may not be advertised, offered, or provided to the public
25+except by an emergency medical services operator that provides the emergency
26+medical services through emergency medical services personnel.
2127 3.Except as otherwise provided under subsection 4, anAn emergency medical services
22-operatorservices operation must be separately licensed for each of the operator's emergency
23-medical services operations and an operation that is headquartered from a separate location
24-must be considered a separate operationthe designated service area of the operation. Under
25-this subsection, an operation with a single headquarters site may dispatchposition vehicles
26-and emergency medical services personnel fromat more than one location if calls requesting
27-services are received and orders for vehicle dispatch are made at the single headquarters
28-sitewithin the designated service area of an emergency medical services operation.
29-4.Notwithstanding subsection 3, an operator of an emergency medical services operation may
30-operate one or more substation ambulance services operations under a single license if:
31-a.The substation ambulance services operation was designated before December 31,
32-2024, and remains continuously designated;
33-b.The headquarters ambulance services operation is not a substation ambulance services
34-operation of another emergency medical services operation;
35-b.c.The substation ambulance services operation area borders the headquarters ambulance
36-services operation area or borders another substation of the headquarters ambulance
37-services operation;
38-c.d.The headquarters ambulance services operation and the substation ambulance services
39-operation are dispatched by the same entity; and
40-d.e.The operator of the emergency medical services operation pays a license fee for each of

60+4.Notwithstanding subsection 3, an operator of an emergency medical services

4274 5.The provisions of this chapter do not apply to an operator from another state which is
43-headquartered at a location outside of this state and transports patients across state lines, but
44-the operator may not treat patients within this state or pick up patients within this state for
45-transportation to locations within this state, except as provided by rule.
46-6.The department of health and human services shall adopt rules for special licenses and
47-waiver provisions for an operator of an emergency medical services operation intended for
48-industrial sites not available to the general public.
49-SECTION 2. AMENDMENT. Section 23-27-02 of the North Dakota Century Code is amended and
50-reenacted as follows:
75+headquartered at a location outside of this state and transports patients across state
76+lines, but the operator may not treat patients within this state or pick up patients within
77+this state for transportation to locations within this state, except as provided by rule.
78+6.The department of health and human services shall adopt rules for special licenses
79+and waiver provisions for an operator of an emergency medical services operation
80+intended for industrial sites not available to the general public.
81+SECTION 2. AMENDMENT. Section 23-27-02 of the North Dakota Century Code is
82+amended and reenacted as follows:
5183 23-27-02. Definitions.
5284 For the purpose of this chapter, unless the context otherwise requires:
5385 1."Department" means the department of health and human services.
54-2."Emergency medical services" means the prehospital medical stabilization or transportation,
55-including interfacility transportation, of an individual who is sick, injured, wounded, or
56-otherwise incapacitated or helpless, or in a real or perceived acute medical condition, by a
57-person that holds oneself out to the public as being in that service or that regularly provides
58-that service. The term includes:
59-a.Assessing, stabilizing, and treating life-threatening and non-life-threatening medical
60-conditions; or
61-b.Transporting a patient who is in a real or perceived acute medical condition to a hospital
62-emergency room or other appropriate medical destination.

118+2."Emergency medical services" means the prehospital medical stabilization or

64128 emergency medical services by emergency medical services personnel with physician
65-oversight. The term includes basic life support ambulance services, advanced life support
66-ambulance services, air ambulance services, and quick response unit services.
67-4."Emergency medical services personnel" means individuals who provide emergency medical
68-services for emergency medical services operations. The term includes emergency medical
69-services professionals, drivers, and department-certified emergency medical services
70-providers, such as cardiopulmonary resuscitation drivers and first responders.
71-5."Emergency medical services professional" means an individual licensed by the department
72-under this chapter.
73-6."Substation ambulance services" means an ambulance station that has its own service area
74-designated by the department and is not individually licensed as an emergency medical
