88 A BILL for an Act to amend and reenact subsection 2 of section 39-12-05 and subsection 2 of
99 section 39-12-05.3 of the North Dakota Century Code, relating to weight limitations for vehicles
1010 on the interstate system and weight limitations for vehicles on highways other than the
1111 interstate system.
1212 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
1313 SECTION 1. AMENDMENT. Subsection 2 of section 39-12-05 of the North Dakota Century
1414 Code is amended and reenacted as follows:
1515 2.Subject to the limitations imposed by subsection 1 on tires, wheel, and axle loads, the
1616 gross weight of which exceeds that determined by the formula of:
1717 W = 500 (

1919 /N-1 + 12N + 36)
2020 where W equals maximum weight in pounds carried on any group of more than one
2121 axle; L equals distance in feet between the extremes of any group of consecutive
2222 axles; and N equals number of axles in the group under consideration, except that two
2323 consecutive sets of tandem axles may carry a gross load of thirty-four thousand
2424 pounds [15422.14 kilograms] each, providing the overall distance between the first
2525 and last axles of the consecutive sets of tandem axles is at least thirty-six feet [10.97
2626 meters]. The gross weight may not exceed eighty thousandone hundred thirteen
2727 thousand pounds [36287.3951255.94 kilograms].
2828 SECTION 2. AMENDMENT. Subsection 2 of section 39-12-05.3 of the North Dakota
2929 Century Code is amended and reenacted as follows:
3030 2.Subject to the limitations imposed by subsection 1 on tires, wheel, and axle loads, a
3131 person may not operate on a highway that is not part of the interstate system any
3232 vehicle the gross weight of which exceeds that determined by the formula of:

7272 [47854 kilograms]. Local authorities are encouraged to assess all roads under their
7373 jurisdiction and designate the roads for the appropriate weight limits allowed under this
7474 subsection.
