8	8	A BILL for an Act to amend and reenact subsection 2 of section 39-12-05 and subsection 2 of
9	9	section 39-12-05.3 of the North Dakota Century Code, relating to weight limitations for vehicles
10	10	on the interstate system and weight limitations for vehicles on highways other than the
11	11	interstate system.
12	12	BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
13	13	SECTION 1. AMENDMENT. Subsection 2 of section 39-12-05 of the North Dakota Century
14	14	Code is amended and reenacted as follows:
15	15	2.Subject to the limitations imposed by subsection 1 on tires, wheel, and axle loads, the
16	16	gross weight of which exceeds that determined by the formula of:
17	17	W = 500 (
18	18	LN
19	19	/N-1 + 12N + 36)
20	20	where W equals maximum weight in pounds carried on any group of more than one
21	21	axle; L equals distance in feet between the extremes of any group of consecutive
22	22	axles; and N equals number of axles in the group under consideration, except that two
23	23	consecutive sets of tandem axles may carry a gross load of thirty-four thousand
24	24	pounds [15422.14 kilograms] each, providing the overall distance between the first
25	25	and last axles of the consecutive sets of tandem axles is at least thirty-six feet [10.97
26	26	meters]. The gross weight may not exceed eighty thousandone hundred thirteen
27	27	thousand pounds [36287.3951255.94 kilograms].
28	28	SECTION 2. AMENDMENT. Subsection 2 of section 39-12-05.3 of the North Dakota
29	29	Century Code is amended and reenacted as follows:
30	30	2.Subject to the limitations imposed by subsection 1 on tires, wheel, and axle loads, a
31	31	person may not operate on a highway that is not part of the interstate system any
32	32	vehicle the gross weight of which exceeds that determined by the formula of:

66	66	combination of vehicles under consideration. The gross weight on stateall highways
67	67	may not exceed one hundred five thousand five hundredone hundred thirteen
68	68	thousand pounds [4785451255.94 kilograms] unless otherwise posted and on all other
69	69	highways the gross weight may not exceed eighty thousand pounds [36287.39
70	70	kilograms] unlessor designated by local authorities for highways under their jurisdiction
71	71	for gross weights not to exceed one hundred five thousand five hundred pounds
72	72	[47854 kilograms]. Local authorities are encouraged to assess all roads under their
73	73	jurisdiction and designate the roads for the appropriate weight limits allowed under this
74	74	subsection.
