| 10 | 10 | | BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA: |

| 11 | 11 | | SECTION 1. A new section to chapter 23-12 of the North Dakota Century Code is created |

| 12 | 12 | | and enacted as follows: |

| 13 | | - | Required vaccine - Opt - out procedure. |
|---|
| 14 | | - | 1.Notwithstanding any other provision of law, a state agency, political subdivision, or any |

| 15 | | - | other government entity, may not require an individual to take or receive a vaccine or |
|---|
| 16 | | - | similar product used to prevent a disease, unless there is a procedure made available |
|---|
| 17 | | - | for an opt - out for health, religious, or philosophical reasons. |

| 18 | | - | 2.For a school, day care center, child care facility, head start program, or nursery school, |

| 19 | | - | the provisions of section 23 - 07 - 17.1 must be followed for vaccines and vaccine opt - out |

| 19 | + | a.The department of corrections and rehabilitation; |
|---|
| 20 | + | b.A correctional facility as defined under section 12 - 44.1 - 01; |

| 21 | + | c.A local public health unit; |
|---|
| 22 | + | d.A human service zone; |
|---|
| 23 | + | e.The state hospital; |
|---|
| 24 | + | f.A developmental disability residential facility or other health care provider, |
|---|
| 25 | + | including a long-term care provider, basic care provider, and assisted living |
|---|
| 26 | + | provider; and |
|---|
| 27 | + | g.A school, day care center, child care facility, head start program, or nursery |
