88 A BILL for an Act to amend and reenact section 20.1-03-04 of the North Dakota Century Code,
99 relating to when licenses to hunt, fish, or trap are not required of landowners.
1010 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
1111 SECTION 1. AMENDMENT. Section 20.1-03-04 of the North Dakota Century Code is
1212 amended and reenacted as follows:
1313 20.1-03-04. When licenses to hunt, fish, or trap not required of residents.
1414 Subject to the provisions of this title:
1515 1.Any landowner or resident, or any member of the resident's family residing customarily
1616 with the resident, may hunt small game, fish, or trap during the open season without a
1717 license upon land owned or leased by the landowner or resident.
1818 2.Residents or nonresidents under the age of sixteen years may fish without a fishing
1919 license.
2020 3.Residents may fish at a private fish hatchery without a resident fishing license.
2121 4.Life skills and transition center patients, North Dakota youth correctional center
2222 students, school for the deaf students, North Dakota vision services - school for the
2323 blind students, state hospital patients, clients of regional human service centers under
2424 direct therapeutic care, and residents of facilities licensed by the department of health
2525 and human services may fish without a resident fishing license. Patients of these
2626 institutions must be identified. The department shall issue authority to each institution.
2727 5.Residents may fish without a resident fishing license on free fishing days. The date of
2828 these free fishing days may be set by proclamation by the governor.
2929 6.Residents under age sixteen may take fur-bearers without a fur-bearer license.
3030 7.Residents under age sixteen may take small game or waterfowl without a small game

6060 8.Residents who are enrolled as students or serving as certified instructors during
6161 official aquatics education program events of the game and fish department may be
6262 granted free fishing privileges by discretion of the director.
6363 9.Upon presentation of valid leave papers and a valid North Dakota operator's license, a
6464 resident who is on leave and is on active duty as a member of the United States
6565 armed forces or the United States merchant marine may hunt small game, fish, or trap
6666 during the open season without a license.
