8+A BILL for an Act to provide for a legislative management study on the circumstances and
9+needs of special education teachers and the related special education teacher shortage.
810 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
9-SECTION 1. LEGISLATIVE MANAGEMENT STUDY - RECRUITMENT AND RETENTION OF
10-SPECIAL EDUCATION TEACHERS.
11-1.During the 2025-26 interim, the legislative management shall consider studying special
12-education teacher shortages, circumstances, and collective needs. The study must include:

12+OF SPECIAL EDUCATION TEACHERS.
13+1.During the 2025-26 interim, the legislative management shall consider studying
14+special education teacher shortages, circumstances, and collective needs. The study
15+must include:
1316 a.Special education teacher workload, including:
1417 (1)Significant and inequitable disparities in caseload numbers and complexities
1518 between educators;
16-(2)Addition of students to a special education's workload throughout the year without
17-consideration of impact on students' needs and teachers' workload;
19+(2)Addition of students to a special education's workload throughout the year
20+without consideration of impact on students' needs and teachers' workload;
1821 (3)Lack of a subjective formula for teaching, workload, and case management
1922 assignments;
20-(4)Unsatisfactory policies and formulas adopted without special educator involvement,
21-adequate training, or with general or vague language; and
22-(5)Burdensome workloads threatening compliance with student individual education
23-plans and state and federal law.

29-(3)Lack of training in the use of protective equipment and restrictive procedures;
30-(4)Uncompensated time for planning and implementing behavior intervention plans
31-separate from teacher preparation time;
32-(5)Lack of adequate space to meet the needs of students demonstrating violent
33-behavior;
34-(6)The unmet need for additional highly qualified paraprofessional support in situations
35-involving students with violent behavior; and
36-(7)The inequitable treatment of injured staff who must use sick leave or unpaid leave
37-due to injuries that occurred at work.
38-c.Special education paraprofessional management duties, including: H. B. NO. 1530 - PAGE 2
39-(1)Additional expectation that education, training, and professional development of
40-paraprofessionals are an obligation of the special education teacher;
41-(2)Additional requirement that special education teachers schedule and annually
42-evaluate paraprofessionals;
60+(3)Lack of training in the use of protective equipment and restrictive
61+procedures;
62+(4)Uncompensated time for planning and implementing behavior intervention
63+plans separate from teacher preparation time;
64+(5)Lack of adequate space to meet the needs of students demonstrating
65+violent behavior;
66+(6)The unmet need for additional highly qualified paraprofessional support in

4376 (3)Inadequate availability of highly qualified paraprofessionals;
4477 (4)Inadequate training in management of paraprofessionals; and
4578 (5)Failure to provide additional time and compensation for paraprofessional
4679 management duties.
4780 d.Special education paperwork requirements and supports, including:
48-(1)Lack of compensation for extensive federal, state, and disability-related required
49-paperwork;
50-(2)Lack of compensation to attend individual education plan evaluation meetings
51-outside the teacher's workday or during teacher preparation time; and
52-(3)Lack of additional time, training, mentoring, administrative and professional support
53-and assistance necessary to manage mandatory reporting, compliance, and due
54-process issues and requirements.
55-e.Additional or broader considerations, pertinent data review, and plans for remediation of
56-inequities, including projected costs and implementation timetables.
57-2.The legislative management shall report its findings and recommendations, together with any
