12 | 12 | | BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF NORTH DAKOTA, THE |

13 | 13 | | SENATE CONCURRING THEREIN: |

14 | 14 | | That the following proposed new section to article XI of the Constitution of North Dakota is |

15 | 15 | | agreed to and must be submitted to the qualified electors of North Dakota at the general |
---|
16 | 16 | | election to be held in 2026, in accordance with section 16 of article IV of the Constitution of |
---|
17 | 17 | | North Dakota. |

18 | 18 | | SECTION 1. A new section to article XI of the Constitution of North Dakota is created and |
---|
19 | 19 | | enacted as follows: |
---|
20 | 20 | | 1.Every employer shall pay to each of the employer's employees wages at a rate of not |
---|
21 | 21 | | less than nine dollars and twenty-five cents per hour. |
---|
22 | 22 | | 2.Beginning January 1, 2027, and on January first of each year thereafter, the minimum |
---|
23 | 23 | | wage must be adjusted by the increase, if any, in the cost of living. |
---|
24 | 24 | | 3.The increase in the cost of living must be measured by the percentage increase in the |
---|
25 | 25 | | consumer price index for all urban consumers (all items, United States city average) or |
---|
26 | 26 | | its successor index as published by the United States department of labor or its |
---|
27 | 27 | | successor agency for the twelve-month period ending August first of the immediately |
---|
28 | 28 | | preceding year. The amount of the minimum wage increase, if any, must be rounded |
---|
29 | 29 | | up to the nearest five cents. The minimum wage may not be decreased. |
