1212 STATEMENT OF INTENT
1313 This measure provides an individual may not serve more than twelve cumulative years in either
1414 the house of representatives or the senate until after four years have elapsed since reaching
1515 twelve cumulative years of service in that chamber. The measure also places twelve cumulative
1616 year term limits on statewide elected executive branch officers, except the governor and the
1717 lieutenant governor. The measure places eight cumulative year term limits on the governor and
1818 lieutenant governor. The measure repeals a provision prohibiting the legislative assembly from
1919 proposing constitutional amendments relating to term limits.
2020 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF NORTH DAKOTA, THE
2121 SENATE CONCURRING THEREIN:
2222 That the following proposed amendments to sections 1, 2, and 4 of article XV of the
2323 Constitution of North Dakota are agreed to and must be submitted to the qualified electors of
2424 North Dakota at the general election to be held in 2026, in accordance with section 16 of
2525 article IV of the Constitution of North Dakota.
2626 SECTION 1. AMENDMENT. Section 1 of article XV of the Constitution of North Dakota is
2727 amended and reenacted as follows:
2828 Section 1. AnUpon serving twelve cumulative years as a member of the house of
2929 representatives, an individual shallmay not serve as a member of the house of representatives
3030 for a cumulative period of time amounting to more than eight years. Anuntil at least four years
3131 have passed, at which time the individual may serve another twelve cumulative years. A

6161 member of the house of representatives elected or appointed to a term of less than four years is
6262 eligible to serve twelve cumulative years following the completion of the partial term. Upon
6363 serving twelve cumulative years as a member of the senate, an individual shallmay not serve as
6464 a member of the senate for a cumulative period of time amounting to more than eight years. An
6565 individual shall not be eligible to serve a full or remaining term as member of the house of
6666 representatives or the senate if serving the full or remaining term would cause the individual to
6767 serve for a cumulative period of time amounting to more than eight years in that respective
6868 houseuntil at least four years have passed, at which time the individual may serve another
6969 twelve cumulative years. A member of the senate, elected or appointed, to a term of less than
7070 four years is eligible to serve twelve cumulative years following the completion of the partial
7171 term.
7272 SECTION 2. AMENDMENT. Section 2 of article XV of the Constitution of North Dakota is
7373 amended and reenacted as follows:
7474 Section 2.
7575 1.An individual shallmay not be elected to the office ofserve as the governor more than
7676 twiceor lieutenant governor for more than eight years. This provision shalldoes not
7777 prevent the lieutenant governor from succeeding to the office of governor, nor prevent
7878 the secretary of state from acting as governor.
7979 2.An individual may not serve more than twelve cumulative years as agriculture
8080 commissioner, attorney general, auditor, insurance commissioner, lieutenant governor,
8181 public service commissioner, secretary of state, superintendent of public instruction,
8282 tax commissioner, or treasurer unless at least four years have passed after having
8383 completed twelve years of service. After four years have passed, the individual may
8484 serve another twelve cumulative years in the office. An individual who is serving as
8585 agriculture commissioner, attorney general, auditor, insurance commissioner, public
8686 service commissioner, secretary of state, superintendent of public instruction, tax
8787 commissioner, or treasurer and was elected or appointed to complete a partial term is
8888 eligible to serve twelve cumulative years following the completion of the partial term.
8989 SECTION 3. REPEAL. Section 4 of article XV of the Constitution of North Dakota is

123123 SECTION 4. APPLICATION. Any service in the senate or the house of representatives
124124 before December 1, 2026, for any member elected in 2026; any service in the senate or the
125125 house of representatives before December 1, 2028, for any member elected at the general
126126 election in 2028; and any service as a statewide elected official, except as the governor or
127127 lieutenant governor, before January 1, 2027; may not be counted toward cumulative years of
128128 service in that office.
